1. NEW GUIDELINES FOR REPORTING AND COMPLIANCE Title IX and SaVE ACT

2. What is the Clery Act? The Clery Act is named after Jeanne Clery who was raped and murdered in her dorm room by a fellow student of April 5, 1986. Her parents championed the Jeanne Clery Disclosure of Campus Security Policy The Clery Act also contains the Campus Assault Victim’s Bill of Rights

3. The Clery Act requires: Annual reporting of statistics for various criminal offenses including forcible and non-forcible sex offenses and aggravated assault. The Campus Sexual Assault Victim’s Bill of Right contains, educational obligations, discipline process and victim’s right regarding sexual violence. The SaVE Act adds domestic violence, dating violence and stalking

4. When is a crime considered on Campus? When it occurred on school grounds Within school owned buildings Could extend to public property adjacent to campus Distant classrooms

5. All Colleges and Universities are required to: Report domestic violence, dating violence and stalking and other mandatory crimes Adopt student procedures for notifying purported victims of their rights Adopt policies to address and prevent campus sexual violence

6. Domestic Violence Includes misdemeanor and felony offenses committed by the victim’s current or former spouse, current or former cohabitant or person stated under the domestic and family violence laws

7. Dating Violence Violence by a person who has been in a romantic or intimate relationship with the victim. Whether there is a relationship will be judged by type, length and interaction

8. Stalking Conduct directed at a specific person that would cause a reasonable person to fear for her/his or other’s safety or to suffer substantial emotional distress

9. Student Discipline Requirements If students are victims of crimes under the Clery Act they should:  Try to preserve evidence that a crime was committed to the best of their ability  Report the crime to a “responsible campus employee”  Seek safety and assistance while proper authorities are allowed to start an investigation.

10. Once a crime is reported, EITC will: Take steps to STOP the harassment Remedy the effects where possible Prevent the reoccurrence

11.  Offer accuser and accused the same requirements to privacy and protection  Keep all parties informed during the investigation of the incident

12. Standards for an investigation: A “preponderance of the evidence” will be used for the standard of evidence Trained individuals will conduct the investigation to protect the safety of victims EITC will take protective steps and promote accountability such as:  Changing schedules of students  Prevent retaliation  Issue warnings or suspensions  Informing local police when appropriate

13. Reporting Students should report any violation or harassment to a “responsible employee”.
