Environmental and Historic Review Process All CTEP projects must comply with the National Environmental Policy Act (NEPA) just as MDT projects CTEP Environmental Checklist will decide which type of Enviro Document to write Section 106 of the National Historic Preservation Act requires that federally assisted undertakings (CTEP Projects) take into account the effect of the project on properties included in or eligible for the National Register of Historic Places As in MDT projects, CTEP projects may not incur Right of Way expenses, advertise for bids or begin construction on a project until the environmental requirements have been approved by MDT and the FHWA

Environmental Documents EA’s or EIS’s. If it’s decided that an EA or EIS is needed for a CTEP project...forget it. With limited funds it’s not really worth it. Categorical Exclusions Are actions that do not involve significant environmental impacts Signifies completion of Environmental Review Two Types CatEx Group “c” – 23 CFR 771.117 (c) CatEx Group “d” – 23 CFR 771.117 (d) Most CTEP projects with no significant impacts use a Group “c” letter Historical Preservation projects and projects with lots of permitting and/or mitigation will use a Group “d” letter

Federal Regulations – Civil Rights As with other MDT projects, CTEP must follow all Federal Civil Rights Regulations CTEP is assisted by the MDT Civil Rights Bureau for compliance on our projects Disadvantaged Business Enterprises Leslie Wootan-Hartung – DBE Coordinator The MDT Disadvantaged Business Enterprise (DBE) Program encourages and supports the participation of companies owned and controlled by socially and economically disadvantaged individuals in transportation contracts Labor Compliance Jim Phillips – Program Manager This program ensures that Davis-Bacon wage rates and fringe benefits are paid to highway construction workers on contracts and subcontracts valued at more than $2,000

Federal Regulations – Civil Rights EEO Contract Compliance Sheila Cozzie – Program Manager This program ensures that federal-aid highway projects valued at more than $10,000 make a "good faith effort" to assure that applicants are employed and that employees are treated during employment, without regard to their race, religion, sex color, disability, age, marital status, political belief or national origin. Title VI Compliance Bill Anderson – Program Manager This program ensures that all programs, benefits, and services offered to the general public by MDT are free from discrimination based upon certain enumerated statuses (e.g., race, color, national origin, etc.)

Department of Justice, not FHWA Alice Flesch – Program Manager The ADA Program is responsible for consulting with the Design Bureau to provide plans of accessible sidewalks and street crossings ADA Standards for Accessible Design http://www.usdoj.gov/crt/ada/adahom1.htm http://www.usdoj.gov/crt/ada/adahom1.htm MDT Standard Drawings are an excellent reference for ADA compliant Sidewalk, Curb & Gutter drawings

Federal Regulations – Civil Rights ADA Quick Notes Cross slopes on Sidewalks or Trails cannot be more than 2%...preferably 1.5%. Any running slope > 5% is considered a ramp. Ramps cannot be greater than 8.33%. Ramps shall have level landings at bottom and top of each ramp. Detectable Warnings must be placed before sidewalk or trail crosses streets/roads. Detectable warnings shall consist of raised truncated domes with a diameter of nominal 0.9 in (23 mm), a height of nominal 0.2 in (5 mm) and a center-to-center spacing of nominal 2.35 in (60 mm) and shall contrast visually with adjoining surfaces, either light-on-dark, or dark-on-light.
