New Law- AB1729- District updated in late January AB 1729 (Chapter 425/2012) expands the definition of electronic bullying and authorizes alternative methods of correction to be used before a student is suspended or expelled. These other means include, but are not limited to: AB 1729 A positive behavior support approach with tiered interventions that occur during the school day A conference between school personnel, the pupil's parent or guardian, and the pupil The use of intervention-related teams to develop and implement individualized behavioral plans Participation in a restorative justice program After-school programs that address specific behavioral issues or expose pupils to positive activities and behaviors

Board Policy - 4040 “The Board of Education recognizes that technology can enhance employee performance by improving access to and exchange of information, offering effective tools to assist in providing a quality instructional program, and facilitating operations. The Board expects all employees to learn to use the available electronic resources that will assist them in their jobs. As needed, staff shall receive training in the appropriate use of these resources.”

Board Policy - 5131 “Employees shall be responsible for the appropriate use of technology and shall use the district's electronic resources only for purposes related to their employment. Such use is a privilege which may be revoked at any time.”

Board Policy - 4040 “The Superintendent or designee shall establish administrative regulations which outline employee obligations and responsibilities related to the use of technology. Employees who fail to abide by these regulations shall be subject to disciplinary action, revocation of the user account and legal action as appropriate.”

Administrative regulation - 4040 User Obligations and Responsibilities Employees are authorized to use the district's on-line services in accordance with user obligations and responsibilities specified below. 1. The employee in whose name an on-line services account is issued is responsible for its proper use at all times. Users shall keep personal account numbers, home addresses and telephone numbers private. They shall use the system only under their own account number. 2. Employees shall use the system only for purposes related to their employment with the district. Commercial, political and/or personal use of the system is strictly prohibited. The district reserves the right to monitor any on-line communications for improper use. 3. Users shall not use the system to promote unethical practices or any activity prohibited by law or district policy.

Administrative Regulation- 5131 4. Users shall not transmit material that is threatening, obscene, disruptive or sexually explicit, or that could be construed as harassment or disparagement of others based on their race, national origin, sex, sexual orientation, age, disability, religion or political beliefs. 5. Copyrighted material may not be placed on the system without the author's permission. Users may download copyrighted material for their own use only and only in accordance with copyright laws. (cf. 6162.6 - Use of Copyrighted Materials)6162.6 6. Vandalism will result in the cancellation of user privileges. Vandalism includes uploading, downloading or creating computer viruses and/or any malicious attempt to harm or destroy district equipment or materials or the data of any other user. 7. Users shall not read other users' mail or files; they shall not attempt to interfere with other users' ability to send or receive electronic mail, nor shall they attempt to read, delete, copy, modify or forge other users' mail. 8. Users are encouraged to keep messages brief. 9. Users shall report any security problem or misuse of the network to the Superintendent or designee.

Board Policy- 5131 “Harassment or bullying of students or staff, including, but not limited to, cyberbullying, intimidation, hazing or initiation activity, emotional distress, extortion, or any other verbal, written, or physical conduct that causes or threatens to cause violence, bodily harm, or substantial disruption, in accordance with the section entitled "Bullying/Cyberbullying" below”

Board Policy - 5131 “Cyberbullying includes the transmission of communications, posting of harassing messages, direct threats, or other harmful texts, sounds, or images on the Internet, social networking sites, laser device, or other digital technologies using a telephone, computer, or any wireless communication device. Cyberbullying also includes breaking into another person's electronic account and assuming that person's identity in order to damage that person's reputation.”

ED CODE Section 44932 Causes for Dismissal (1) Immoral or unprofessional conduct. (2) Commission, aiding, or advocating the commission of acts of criminal syndicalism (3) Dishonesty. (4) Unsatisfactory performance. (5) Evident unfitness for service. (6) Physical or mental condition unfitting him or her to instruct or associate with children. (7) Persistent violation of or refusal to obey the school laws of the state or reasonable regulations prescribed for the government of the public schools by the State Board of Education or by the governing board of the school district employing him or her.

Know how all of your devices are connected; Know what equipment you are using and who owns it; Know where your equipment is at all times- cell phone, laptop, tablet, etc.; Know who is using your equipment; Use work equipment for work stuff only; Review rules with students at least each semester; AND
