The law is not very clear. There are multiple opinions on the interpretation of the law. Keep in mind that for labor purposes, the interpretation that most favor employees will prevail. Issues

Outsourcing – Companies are now required to have, at least, one employee. – Not all of the employees of a company may be hired by an outsourcing company. – Document what position require degree of “specialty”. – Review all current agreements with third parties to confirm whether outsourcing rules apply. – Review current outsourcing/insourcing rules.
