3 SR 100 CRA Background and Purpose Background –Established April 20, 2004 –30 Year Time Horizon –Tax Increment Financing (future revenue from CRA pays for improvements to encourage redevelopment) Purpose –Improve and/or Redevelop Blighted Areas Midway Subdivision Whispering Pines Subdivision –Establish the City’s “Downtown” or Urban Core –Encourage Development of Additional Commercial Corridor (Alternative to Palm Coast Parkway)

12 Remaining Right-of-Way Two Parcels Owned by Mr. Ajram Leased to Two Tenants (Operating Businesses) Negotiating Since 2007 and Before Appraisal of $466,000 for Both Parcels (August 2009) Multiple Intermediaries and Multiple Proposals To Avoid Eminent Domain, Staff Offered Double the Appraised Value Final Offer by Mr. Ajram was $1,250,000 Negotiations have Reached an Impasse

13 Remaining Right-of-Way Next Steps –Assembled Eminent Domain Team (City Attorney, Appraiser, Environmental Firm, and Design Team) –Preliminary Evaluation of Negotiations and Costs Associated with Eminent Domain (Only for Portion of Property Required for Street Improvements) –Team Concluded that Cost of Eminent Domain Acquisition < Appraised Value for Total Parcels

14 Remaining Right-of-Way Next Steps –City Attorney Advised Staff to Negotiate Settlement Agreements with the Tenants before Initiating Eminent Domain Process –Tenants Provided Estimated Costs of Relocation and Business Damages to City Staff –Negotiated Settlements were Reached with Tenants
