2 LEAVE RULES-GENERAL PRINCIPLES
1.Leave can’t be claimed as a matter of right. 2.Leave sanctioning authority can sanction/refuse/revoke leave of any kind but can’t alter the kind of due and applied for. 3.Leave of any kind can not be granted for a continuous period exceeding five years. 4.An official on leave should not take up any service or employment elsewhere without obtaining prior sanction of the government.

3 KINDS OF LEAVE 1.Earned leave. 2.Half pay leave. 3.Commuted leave.
4.Leave not due. 5.Extraordinary leave.

4 3.Leave for adoption of a child. 5.Special disability leave.
SPECIAL KINDS OF LEAVE 1.Maternity leave. 2.Paternity leave. 3.Leave for adoption of a child. 4.Child care leave. 5.Special disability leave. 6.Hospital leave. 7.Study leave.

5 3.Incomplete months will not be taken in to account.
EARNED LEAVE. 1.Credited to the leave account in advance on and on at the rate of 15 days for each 6 months. 2.Credit for the half year in which the official is appointed or retired or removed / dismissed from service or died while in service will be afforded at the rate of 2.5 days for each completed months of service ,fraction of the day rounded off to the nearest day. 3.Incomplete months will not be taken in to account. 4.Credit to be afforded will be reduced by 1/10 of Exol availed or Diesnon imposed during the previous half year subject to a maximum of 15 days and to the extent of such credit only.

6 EARNED LEAVE(contd) 5.If an official retires/resigns/is removed /is dismissed/dies in the middle of the half year the earned leave credited in advance should be reduced by 1/10 th of Exol/diesnon relating to that half year. 6.Can be accumulated up to 300 days 7.When the balance is between days further credit of 15 days will be kept separately and set off against any leave availed of during that half year. 8. Balance in excess of 300 days will lapse.

7 EARNED LEAVE(contd) 12.Holidays can be prefixed /suffixed.
9.Can be availed up to maximum of 180 days at a time. 10.Leave salary will be equivalent to last pay drawn. 11.Can be availed in combination of other kinds of leave also. 12.Holidays can be prefixed /suffixed.

8 HALF PAY 1.Credited to the leave account in advance on and on at the rate of 10 days for each 6 months. 2.Credit for the half year in which the official is appointed or retired or removed / dismissed from service or died while in service will be afforded at the rate of 5/3 days for each completed months of service ,fraction of the day rounded off to the nearest day. 3. Incomplete months will not be taken in to account

9 HALF PAY 5.If an official retires/resigns/is removed /is dismissed/dies in the middle of the half year the HPL credited in advance should be reduced by 1/18 th of Exol/diesnon relating to that half year. 6.Leave salary will be equivalent to half of last pay drawn. 7.Can be availed in combination of other kinds of leave also. 8. Holidays can be prefixed /suffixed

10 COMMUTED LEAVE. 1.Can be availed only on medical grounds.
2.Twice the number of HPL will be debited. 3.Leave salary will be equivalent to LPD. 4.Can be granted without a medical certificate i)up to 60 days in continuation of ML ii) up to 60 days in continuation of leave for adoption of a child. iii) up to 60 days in entire service if utilized for an approved course of study.

11 LEAVE NOT DUE 1.It is granted on Medical certificate to an official having no HPL at his credit. 2. Can be granted without a medical certificate i) in continuation of ML ii) in continuation of leave for adoption of a child. 3.LND will be debited against HPL that the official may earn subsequently. 4. Leave salary will be equivalent to half of LPD. 5.LND will be limited to 360 days in entire service of an official. 6.Should be limited to the HPL that the official may likely to earn in his remaining service.

12 LEAVE NOT DUE(contd) 7.If a portion of LND already sanctioned could not be adjusted due to the official resigns or proceeding on VR then the LND sanctioned should be cancelled and overpayment of leave salary recovered. 8.If the official dies or is retired prematurely on FR56(J)or(L) or proceeding on VR due to ill health then the leave salary in respect of the unadjusted portion of LND need not be recovered. 9.It can also be granted to an official who is already having minus balance in HPL.

13 EXTRAORDINARY LEAVE 1.EXOL is granted when no other leave is admissible. 2.If the official asks for EXOL specifically it can be granted even when other kinds of leave is admissible. 3.Following are the various limits for grant of EXOL on any one occasion. 4.No leave salary is admissible except HRA with conditions.

CATEGORY OF OFFICIALS LIMITS All officials. Up to 3 months with or without MC. Officials with minimum of 1 year service. Up to 6 months with MC. For common ailments and 18 months in certain specific diseases. Officials with three or more years’ continuous service Up to 24 months for the purpose of executing higher studies SC/ST officials Exceeding three months for attending pre examination t aining course

15 MATERNITY LEAVE. 1.Admissible to female employees with less than two surviving children. 2.180 days for pregnancy. 3.45 days in entire service of an official for Miscarriage/abortion including induced abortion but not admissible for threatened abortion 3(a).Not linked with no.of surviving children. 4. Can be availed in different spells. 5.MC not necessary for availing commuted leave up to 60 days and LND in continuation of ML. 6.Leave salary will be equivalent to the LPD. 7.Can be availed in combination of other kinds of leave.

16 PATERNITY LEAVE 1.Admissible to male govt servant with less than two surviving children. 2.15 days for wife’s confinement or valid adoption of a child below the age of one year. 3. Leave salary will be equivalent to the LPD. 4 .Can be availed in combination of other kinds of leave. 5.To be applied up to 15 days before or up to six months from the date of delivery or from the date of valid adoption. 6.If not availed within this period it will lapse.

17 LEAVE FOR ADOPTING A CHILD.
1.Granted to female govt servants with less than two surviving children for valid adoption of a child below the age of one year. 2.Leave is for a period of 180 days. 3. Leave salary will be equivalent to the LPD . 4 .Can be availed in combination of other kinds of leave.

18 CHILD CARE LEAVE 1.Women employees having minor children are eligible.
2.730 days during entire service for taking care of up to two eldest children. 3.Not admissible if the child’s age is 18 years or more 4.In cases of child with disablity,CCL is admissible up to the age of 22 years of such child. 5. Leave salary will be equivalent to the LPD . 6. Can be availed in combination of other kinds of leave. 7.May not be granted for a spell less than 15 days 8. May not be granted in more than 3 spells in a calendar year. 9.Even if EL is available CCL can be granted if asked for. 10.CCL account should be separately maintained.

19 ENCASHMENT OF EL 1.At the time of retirement/death of an official Earned leave available at the credit of the official can be encashed. 2.Maximum admissible is 300 days. 3.Leave salary is equivalent to the LPD. 4.If EL at the credit of the official falls short of 300 days, and HPL is available, then HPL can be encashed subject to an overall maximum of 300 days.(EL+HPL) 5.In that event the Leave salary for HPL is equivalent to half of the LPD

20 ENCASHMENT OF EL FOR AVAILING LTC
1.EL can be encashed at the time of availing LTC. 2.Maximum of 10 days can be encashed at a time. 3.Maximum 60 days during entire service. 4.The remaining balance of EL at credit should not be less than 30 days. 5.This encashment will not be taken in to account for computing 300 days of EL at the time of retirement. 6.If husband and wife are employed both are eligible for the encashment
