2 Trade with non-Parties Article X, Trade with States not Party to the Convention, states: –Where export or re-export is to, or import is from, a State not a Party to the present Convention, comparable documentation issued by the competent authorities in that State which substantially conforms with the requirements of the present Convention for permits and certificates may be accepted in lieu thereof by any Party

3 Trade with non-Parties Export from a non-Party is possible if: –The country has informed the Secretariat of its authorities competent to issue CITES comparable documents and to make the required non-detriment findings (this information is available from the CITES web site) Resolution Conf. 9.5 (Rev. 4 Trade with non-Parties Information on non-Party authorities is provided in the national contact database on the CITES website

5 Trade with non-Parties Specimens are accompanied by documents comparable to CITES documents –Documents must contain: i.the name, stamp and signature of a competent issuing authority; ii.sufficient identification of the species concerned for the purposes of the Convention; iii.certification of the origin of the specimen concerned, including the export permit number from the country of origin, or justification for omitting such certification; 5

6 Trade with non-Parties iv.in the case of export of specimens of a species included in Appendix I or II, certification to the effect that the competent scientific institution has advised that the export will not be detrimental to the survival of the species and that the specimens were not obtained in contravention of the laws of the State of export; v.in the case of re-export, certification to the effect that the competent authority of the country of origin has issued an export document that substantially meets the requirements of Article VI of the Convention; and vi.in the case of export or re-export of live specimens, certification to the effect that they will be transported in a manner that will minimize the risk of injury, damage to health or cruel treatment. 6

7 Trade with non-Parties Resolution Conf. 9.5 (Rev. CoP16) contains further details on the regulation of trade with States not party to the Convention Particular attention should be given to the inspection of specimens in transit from or to non-Parties and to the documents that accompany them 7

8 Trade with non-Parties Trade in Appendix-I specimens For import from a non-Party State involving a CITES Appendix- I specimen of wild origin: –Parties should authorize the import from or (re-)export to such States only where: it benefits conservation it provides for the welfare of the specimens … and only after consultation with the Secretariat 8

9 Trade with non-Parties Trade in Appendix-I specimens For import from a non-Party State involving a CITES Appendix-I specimen of captive bred or artificially propagated origin: –Imports from such States are allowed only after favorable advice from the Secretariat 9
