(1)When this permit is renewed, the new limitations may not be equal to the above limitations. (2)There shall be no discharge of floating solids or visible foam other than trace amounts. (3)When the nutrient loading allocation for the Swan Point WWTP is issued under the Chesapeake Bay 2000 Agreement and/or a Tributary Strategy finalized under the Agreement, this permit may be reopened and new nutrients provisions added as appropriate. The permit may also be reopened to be reissued in accordance with the requirements of MDE’s Watershed Permitting Plan under which all discharge permits in a watershed are issued in the same year. (4) Upon completion of the upgrade, the permittee shall make a best effort to achieve a nitrogen concentration performance goal of 3 mg/l. The permittee shall also make a best effort to achieve a load of 7,309 lbs/year for total nitrogen. To establish performance with respect to this goal, the permittee will report to MDE monthly, the cumulative total nitrogen load. The nitrogen concentration performance goal will also be reported on as a monthly average. Total nitrogen is the sum of ammonia-N, organic-N, and (nitrite + nitrate)-N based on samples collected on the same day.
