Radioactive Waste Revise definition of Radioactive Waste in Part 110 –Increase consistency with domestic treatment –Import/export of rad. waste for recycling, treatment, or other management process that generates material for disposal would require specific license –Delete “Incidental Radioactive Material” and broaden exception for recovery/reuse at facilities 5

6. Export of Byproduct Material 10 CFR § 110.23 – Revised to clarify and address inconsistencies Separate requirements for each radionuclide or group of radionuclide for clarification Clarify and reorganize general license for Americium-241, Neptunium, and tritium 6

7. Public Comments 75-day comment period closed: September 8, 2009 14 letters commenting on the proposed rule from: –Individuals, licensees, Federal & State agencies, and citizen, environmental, and industry groups 7

8. Status The 10 CFR Part 110 Final Rule is currently being reviewed by The Commission Publication in the Federal Register is anticipated for later this year. The rule becomes effective 30 days after publication as a Final Rule. 8
