3. Committees are required in terms of the Financial Management of Parliament Act (No. 10 of 2009) section 14 and 15 to develop a strategic plan and an annual performance plan. Purpose of workshop to provide inputs into Committee priority areas over 5-year period Objectives are of the workshop: Deliberate on inputs into the Strategic Plan and Annual Business Plan Demarcate functions between PCODMV and JSCD Determine working relationship between PCODMV and JSCD Plan the processing of the 2014 Defence Review Outcomes are to identify key priorities over five year period and develop a strategic and annual performance plan Will enable Committee to focus on critical areas when exercising its oversight over the DOD, DMV, Armscor and Castle Control Board. 3 INTRODUCTION

Constitutional Mandate Mandate of Parliament derives from the following sections of the Constitutions: Section 55  S 55 (1) (a) consider, pass, amend or reject any legislation before Assembly and (b) initiate or prepare legislation except money Bills  (2)(a) to ensure that all executive organs of state in the national sphere of government are accountable to it and (b) to maintain oversight Section 59  S 59(1) (a) facilitate public involvement in the legislative and other process of Assembly and its committees Section 40  S 40 (1) Government is constituted as national, provincial and local spheres which are distinctive, interdependent and interrelated and (2) Must observe and adhere to the principles of co-operative government Section 231  S 231 (1) the negotiating and signing of all international agreements is the responsibility of the national executive and (2) an international agreement binds the Republic only after it has been approved by resolution in both the National Assembly and the National Council of Provinces 4

5. 5 Joint Standing Committee on Defence Section 228 of the 1993 interim Constitution refers to the functions of the JSCD as follows: “The committee shall be competent to investigate and make recommendations regarding the budget, functioning, organisation, armaments, policy, morale and state of preparedness of the National Defence Force and to perform such other functions relating to parliamentary supervision of the Force as may be prescribed by law.”

11. Possible Demarcation It is difficult to precisely demarcate every committee’s functions as these are likely to overlap. Joint management meetings can be conducted to clarify these issues beforehand. Departing point can be that where ever the two Defence Committees can, joint oversight visits and study tours should be considered Joint meetings can be considered on cross-cutting issues such as the Military Veterans, the 2014 Defence Review, the Military Ombud, the Defence Force Service Commission and the Reserve Force and Reserve Force Council. Bearing in mind the Constitutional imperatives, NA Rules and Joint Rules as well as developing practices, the following demarcation proposal can be considered. 11

13. Department of Defence The matters leading to the adverse audit qualification should be addressed with urgency by the DOD. The Committee should endeavour to establish a closer relationship with National Treasury and the Standing Committee on Appropriations in order to assist the DOD to address their financial challenges. The Committee should continuously monitor the role of the SANDF in border safeguarding to ensure that it fulfils this crucial function optimally. The Committee should assist with the initiatives to migrate Denel to the Department of Defence. A comprehensive presentation on the defence properties and facilities The role of the Defence Works Formation should be enhanced to address the dire straits of facilities and equipment. The relationship between the DOD and the Military Ombud should be strengthen to address disciplinary issues and resolve cases. The Military Discipline Bill should be fast-tracked to assist with addressing disciplinary challenges in the DOD. 13 Strategic Workshop Resolutions

14. Department of Military Veterans The data base should be consolidated and finalised speedily to advance proper planning and budgeting. A report on the efficacy of the respective means tests for the various benefits should be presented as well as challenges faced in this regard. The migration of former MSDS members to the Reserves should be enhanced to ensure that this feeder system brings about maximum benefits. The finalisation of MOU’s and SLA’s with service delivery agencies should be prioritised to ensure the delivery of benefits based on approved policies. 15. Armscor The appointment of a permanent CEO should be finalised as a matter of urgency. Armscor should enhance its efforts to strengthen and increase local specialised technologies in its products. Castle Control Board The Committee should assist in promoting the Castle as a tourist destination. The revenue and expenditure of the CGH should be monitored continuously to ensure it remains financial viable. 2014 Defence Review The JSCD should commence with the processing of the 2014 Defence Review without delay. A call for submissions from the public and subsequent Public hearings to allow for public involvement and participation into the Defence Review. A presentation by the Department on the proposed Joint Parliamentary Defence Committee (Chapter 4: Directing defence) to allow for engagement on the proposal.
