2 Legislative basis Section 13(1) of Drugs, Poisons & Controlled Substances Act 1981 authorises who can obtain, possess, use, sell or supply Schedule 1 to 9. Regulation 5 specifies who is authorised to possess Shedule 4, 8 & 9. Section 14A allows the Minister to approve the list of drugs for each category Section 14A(2) allows for lists to be expressed in a number of ways

5 DH process for managing submission Registration Board makes submission for drug formulary approval or modification Minister/ Secretary receives submission from Registration Board Responsible DH Program area organises receipt of submission & advises HPDAC of request Initial review of submission against DH criteria undertaken by responsible program area Criteria Met? Request for additional information Submission & Documentation forwarded to Chair, HPDAC HPDAC convened to review submission including relevant DHS program area & makes recommendation Responsible Program area: 1. Briefs Minister/ Secretary & advises of HPDAC recommendation 2. Prepares letter from Minister/ Secretary to advise Board of outcome Responsible Program area: 1. Organises posting of formularies or changes to formularies in Victorian Government Gazette 2. Arranges for posting of formularies on DPRG website Minister/ Secretary approved submission?
