2 Today What are the Premises Standards? What is the aim of the review? How to make a submission

3 Premises Standards - Objectives Aim to: – ensure dignified, equitable, cost-effective and reasonably achievable access to buildings and facilities and services within buildings is provided to people with disability. –provide certainty to the building industry that if the Standards are followed they will not be subject to a complaint under the Disability Discrimination Act 1992 for actions they take under the Standards.

4 Premises Standards – Application Premises Standards came into force on 1 May 2011. Apply to: –new buildings, approved and built since 1 May 2011, and covered by the Standards –pre-existing buildings that have work requiring building approval such as an extension or renovation (new part). The Premises Standards do not apply to buildings that were built or approved for building before 1 May 2011 unless they undergo renovation that needs building approval.

5 What is NOT covered by the Premises Standards? Private residential dwellings (Class 1a buildings) Some short-term holiday accommodation buildings Internal parts of flats or apartments in Class 2 Buildings Buildings which existed, or were approved, prior to the 1 May 2011 Public footpaths, parks, recreation areas, transport conveyances Some wayfinding features Maintenance of buildings Fit-out of buildings that do not require building approval

6 Premises Standards – Operation The Premises Standards have been incorporated into State and Territory building laws and regulation Compliance is through the normal building approval processes Complaints can be made to the Australian Human Rights Commission which has the power to investigate and conciliate complaints of unlawful discrimination.

7 About the Review Began on 17 April 2015 Must be completed by 1 May 2016 First review of the Premises Standards 8-week public submission period –17 April -15 June 2015 Findings will be presented to the Parliamentary Secretary and Minister for Industry and Science, and the Attorney-General

8 Terms of Reference The Review will: 1.Consider the effectiveness of the Premises Standards in achieving their objectives 2.Identify any necessary amendments to the Standards 3.Consider the interaction between the Premises Standards and existing state and territory regulatory schemes for building control 4.Consider inconsistencies in the interpretation and application of the Standards In considering the effectiveness of the Premises Standards the review will consider issues identified in Access All Areas
