FAMILY LEAVE INSURANCE A New Benefit available to New Jersey City University Employees Presented by the Human Resources Office

Purpose Care of a Family Member Bonding with a child

CARE OF A FAMILY MEMBER Benefits are payable for care of a family member with a serious health condition supported by a certification from a health care provider Claims may be filed for 6 consecutive weeks, intermittent weeks or 42 intermittent days Family Member – child (biological, adopted, foster, stepchild, legal ward of a covered individual, child of a domestic/civil union partner who is less than 19 years or age or over 19 and incapable of self care) – spouse – domestic/civil union partner – parent (biological, foster, adoptive, stepparent or legal guardian)

BONDING Benefits are payable for bonding with a newborn or newly adopted child during the first 12 months after the birth or adoption Claim must be for: – Continuous period greater than seven days – Non consecutive periods greater than seven days if permitted by the employer

GENERAL INFORMATION Signed into law May 2, 2008 Signed into law May 2, 2008 Employee contributions started January 1, 2009 through payroll tax deductions Employee contributions started January 1, 2009 through payroll tax deductions July 1, 2009 – claims can be filed under FLI July 1, 2009 – claims can be filed under FLI

Wage Requirement Claimant must have Been employed for at least 20 calendar weeks in New Jersey. Earned $143 or more or $7,200 in 52 weeks immediately prior to the week in which the family leave claim begins

Benefit Duration and Amount Claimant can receive a maximum of six weeks of Family Leave Insurance benefits in a 12 month period. Two-thirds 2/3 of the average weekly wage up to a maximum of $546. – The maximum amount of benefits payable is six weeks.

PROGRAM FUNDING 100% funded by employee contributions through payroll deductions. No employer contributions. The initial payroll deduction is 0.09% of taxable wage base up to $28,900. The payroll deduction will increase to 0.12% of taxable wage base in subsequent years

APPLYING FOR BENEFITS Applications can be obtained: – In writing - Division of Temporary Disability Insurance, PO Box 387, Trenton, NJ 08625-0387 – By phone - Customer Service Section 609-292-7060 – By website – www.nj.gov/laborwww.nj.gov/labor Claimants who receive NJ State temporary disability benefits will receive an FLI application after giving birth Applications should not be mailed until the family leave period begins

Processing the Request Claimant must request a FLI leave through the human resources office using the following guidelines: – care of family member reasonable and practicable notice unless time of leave is unexpected or unforeseeable. 15 days for leave on an intermittent basis – bonding 30 days notice An employer can request that the claimant’s maximum entitlement be reduced, up to two weeks, for any paid time off the employee was required to use.

Application of benefits at NJCU All accrued sick time must be used prior to applying for NJ State Disability All NJ State Disability must be maximized prior to applying for FLI.
