1 Article 12(1) of the UN Convention on the Rights of the Child “States Parties shall assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child.”

2 The significance of Article 12 The ‘cornerstone’ of the CRC. “recognises the child as a full human being with integrity and personality and the ability to participate freely in society.” (Freeman, 2000). Not just a right in itself but also a means of realising other rights. A barometer for children’s rights more generally.

6 Article what? The Voice of the Child/Pupil? The Right to be Heard? The Right to Participate/ be Involved in Decision-Making? The Right to be Consulted? The Right to Have a Say? “While these provide a convenient shorthand … each has the potential to diminish its impact as they convey an imperfect summary of what it requires”.

7 “Voice” is not enough SPACE: Children must be given the opportunity to express a view VOICE: Children must be facilitated to express their views AUDIENCE: The view must be listened to. INFLUENCE: The view must be acted upon, as appropriate.

10 What others find useful It places emphasis on Audience and Influence: It is not hierarchical. “ not an option which is in the gift of adults/policy makers but a legal obligation which is the right of the child” “Right not a duty” It demonstrates the inter-relationship between Art. 12 and other rights.
