2 Fourth Amendment The right of the people to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

4 Databases & Information Protecting the Many from the Few vs. Innocent until PROVEN guilty

5 Databases & Information Has 9/11 Changed how we feel about data being collected…. Airport searches No Fly list Profiling Passports to cross the border into Canada or Mexico

6 Privacy & Health Is medical/health information more sensitive than other information? WHY? If it is more private, is it better protected?

7 Privacy & Health Who pays for our health care? So who gets to say who can see our information?

8 Privacy & Health Until 2003, our medical records were available to insurance companies, employers, and government agencies… Is this a problem? Why or why not?

9 Privacy & Health What if you don’t want people to know about certain kinds of medical treatment? What can you do? Law School, Medical School

10 Privacy & Health In 2003 federal government issued rules covering both electronic and paper records. Written consent is required for most disclosures of medical information and health care providers must NOT disclose more information than the minimum amount of information for each purpose.

13 Medical Privacy vs. Public Good Pros and Cons Should there be a national database containing health and personal information on all Americans? Should Americans be required to have an electronic health ID card to be used to verify a person’s eligibility for health care, to store health data and to access medical records?

14 Personal Health Card What about personal health information? Should we carry this information on our person? Once collected, who could see it?
