Child Labor Laws Did you know that employers are only allowed to have high school students work a certain number of hours a week?? Did you know that there are certain hours you are not allowed to work during the school year??

The following slides will help you to know what the laws say regarding high school students who work. Don’t let an employer take advantage of you!!! Know your rights!

Minors Ages 14-15 No Minors may work during the hours when they are required to attend school. May work farm labor & selling/distributing newspapers: –No more than 3 hours on any school day –No more than 8 hours on a Saturday or non- school day –No more than 18 hours in any week –No more than 6 days in any week

Minors Ages 14-15 (continued) If employed as part of a NYS Approved Work Experience Program: –May work 3 hours on a school day –May work 23 total hours a week

Minors Ages 16-17 No more than 4 hours on any day before a school day No more than 8 hours on Friday, Saturday, Sunday or Holiday No more than 28 hours in any week No more than 6 days in a week

Minors Ages 16-17 (continued) If enrolled in a NYS Approved Work Experience Program –May be employed up to a maximum of 6 hours on a day before a school day other than a Sunday or a holiday

Summer or Vacations (School must be closed for a calendar week) Under 18: –No more than 8 hours a day – No more than 6 days a week –14-15 years old – no more than 40 hours a week –16-17 years old – no more than 48 hours a week

Night Work Under 16 years of age: –Between Labor Day to June 20 May not work between 7pm - 7am in most jobs after Labor Day to June 20 –Between June 21 st to Labor Day May not work between 9pm - 7am (Newspaper carriers – no working between 7pm & 5am) (Street trades – no working between 7pm & 6am)

Night Work 16-17 years of age –No working between midnight -6am when school is not in session –May work after 10pm – midnight during the school year ONLY with written consent by a parent and in good academic standing at school

There are many laws regarding when minors may work. It is the employer’s job to follow the laws. It is your job to make sure that you have provided your employer with working papers and your social security number. Do not work “off the books” or “under the table”. It is against the law. If you are not sure whether the hours you are being asked to work are legal for your age, please come see me.
