1 Family Medical Leave Act of 1993 (FMLA) Employers must comply with FMLA guidelines it is a federal law governed by the Department of Labor FMLA is not additional paid leave but runs concurrent with paid or unpaid leave. COVERAGE: Allows eligible employees to take up to 12 weeks of unpaid, job- protected leave for certain family or medical reasons including: 1.Care for a new child, whether for the birth of a child, or for the adoption or placement of a child in foster care; 2.To care for a seriously ill family member (spouse, son, daughter, or parent); General Information: FMLA

2 3. To recover from a worker’s own illness; 4.To care for an injured service member in the family; 5.To address qualifying exigencies arising of a family member’s deployment. Serious illness includes: Inpatient medical care, pregnancy or prenatal care; a health condition lasting three consecutive days coupled with long-term treatment by a health care provider; a chronic, serious condition such as asthma; diabetes or epilepsy for which the person is under the ongoing treatment of a healthcare provider; multiple treatments such as chemotherapy or kidney dialysis; or, a permanent long-term condition for which treatment may not be effective. Note: Illness such as cold or flu are not usually covered unless there are complications. General Information: FMLA

3 An eligible employee may also apply up to 26 weeks of job protection for Military reason to include: To care for a covered service member with a serious injury or illness, when the employee is the spouse, son, daughter, parent or next of kin. General Information: FMLA

4 Eligibility for FMLA: Employed with Clemson University for at least 12 months Have worked at least 1250 hours in the previous 12 months FMLA leave can be used intermittently, meaning not all in one block. Must be certified by a physician. Clemson University employees who have a spouse who also work for here at Clemson and they both apply for FMLA for the same event will have to share the FMLA hours.
