3 3 April 2, 2012 FAR Part 45.000 (Scope of part) update states: (a) This part prescribes policies and procedures for providing Government property to contractors; contractors’ management and use of Government property; and reporting, redistributing, and disposing of contractor inventory. (b) It does not apply to-...... (5) Government Property that is incidental to the place of performance, when the contract requires contractor personnel to be located on a Government site or installation, and when the property used by the contractor within the location remains accountable to the Government. Items considered to be incidental to the place of performance include, for example, office space, desks, chairs, telephones, computers, and fax machines (FAR 45.000). 4 4 ARTICLE H.. ON-SITE CONTRACTOR ACCESS TO GOVERNMENT PROPERTY The Contractor shall be held responsible for Government Property, regardless of dollar value, when: The contract requires contractor personnel to be located on a Government site or installation; The property utilized by contractor personnel is incidental to the place of performance; and, The property used by the contractor remains accountable to the Government Responsibility includes physical presence, proper use and handling, normal maintenance, and reporting Loss, Damage or Destruction. Responsibility for government property shared by two or more contractors or located in space shared by two or more contractors, shall be determined and documented by the contractors involved. In cases where the parties cannot reach agreement on shared responsibility, the matter will be referred to the NIH Property Officer for resolution. Standardized Contracting Language
