Subchapter III: Company Certification Requirements

159.14 -- Company Certification Beginning August 1, 2009 company certification is required. Anyone conducting regulated asbestos abatement or management activities must be affiliated with a certified asbestos company or exterior asbestos company. Applications will be accepted beginning May 1, 2009.

159.15 - 159.18 Certification Process Application form is available at: www.dhs.wi.gov/asbestos/Forms.htm www.dhs.wi.gov/asbestos/Forms.htm Company fees for 2 years: Asbestos company certification -- $400 Exterior asbestos company certification -- $200 Each satellite office of an asbestos company -- $200 Each satellite office of an exterior company -- $100 A certified satellite office will be listed on the published Department company list and will receive mailings directly from the Department. Fee exemption for schools, local governmental agencies and state agencies

Company Responsibilities RECORDKEEPING Retain appropriate records for 3 years. Records include: For all abatement activities: project notifications project logs occupant protection plans All asbestos companies: any written contracts asbestos inspection reports and bulk sampling lab results Companies with exterior asbestos workers: records of annual training for exterior workers

Company Responsibilities when Conducting Abatement Notify DHS/DNR or abatement activities Protect Public Health during abatement activities Maintain a Project Log onsite for each work day of an abatement activity Post an Occupant Protection Plan Ensure Direct Supervision by a certified asbestos supervisor or exterior asbestos supervisor, as appropriate Verify Worker Certification status before allowing in regulated areas

159.21 Contractor Responsibilities Protect public health by using appropriate engineering controls and work practices that prevent the release of asbestos fibers Follow all other federal, state and local asbestos related regulations

159.21 Contractor Responsibilities PROJECT LOG. The company must maintain a project log onsite for each day of an asbestos abatement activity. The daily project log shall include Date Project number and address Name and certification number of supervisor Name, signature, certification number and in/out times for each person entering regulated area.

159.21 Contractor Responsibilities OCCUPANT PROTECTION PLAN. A written occupant protection plan must be posted in plain view outside the regulated area when the facility is occupied or furnished. 159.21 Contractor Responsibilities Occupant Protection Plans must include: Company contact information Property address information Project start and end dates and work schedule Statement that only authorized persons using proper protection may enter regulated areas Description of engineering controls and work practices used to prevent contamination Description of any clearance activities that will be conducted

159.20 Abatement Notification IS REQUIRED to DHS for work in: Residential buildings with fewer than 5 units for Residential buildings with fewer than 5 units for: Removal of more than 1 glove bag or disposal bag of friable or non-friable ACM. Enclosure, encapsulation or repair of more than 3 square feet or 3 linear feet of friable ACM.

Notification Requirements for Residential with 4 or fewer units Type of Activity: Friable Asbestos Non-Friable Asbestos Removal of any amount more than 1 disposal bag* of asbestos-containing material Notify DHS Enclosure, encapsulation or repair involving more than 3 sq. feet or 3 lnr. feet of asbestos-containing material Notify DHSNO notice required * Disposal bag means a heavy duty, impervious waste bag or glove bag no bigger than 60” by 60” properly filled and sealed.

159.20 Abatement Notification IS REQUIRED to DHS for work in: Any facility regulated by NR 447 (DNR) for: Removal of any amount more than 1 glove bag or disposal bag of non-friable ACM. Removal of more than 1 glove bag or disposal bag, but less than NESHAP regulated amounts of friable ACM. Enclosure, encapsulation or repair of more than 3 square feet or 3 linear feet of friable ACM.

Notification Requirements for All Other Facilities including Residential over 4 units Type of Activity: Friable Asbestos Non-Friable Asbestos Removal of more than 1 disposal bag but less than 160 square feet, 260 linear feet, or 35 cubic feet of ACM*. Notify DHS Removal of 160 sq. ft., 260 lnr. ft., or 35 cubic ft., or more, of ACM, or 5,580 sq. ft. or more of asbestos-containing roofing. Notify DNRNotify DHS Enclosure, encapsulation or repair of more than 3 square feet or 3 linear feet. of ACM. (NO removal) Notify DHSNO Notice Required * ACM = Asbestos-Containing Material

159.20 Abatement Notification EXCEPTION TO NOTIFICATION. Notification to DHS is not required when removal is conducted before a fire burn or demolition regulated under NR 447 and notification is made to the Wisconsin Department of Natural Resources.

159.20 Abatement Notification NOTIFICATION FEES. Original notifications: $50 when submitted 2 working days before project start (4 working days postal) $100 when submitted less than 2 working days before project start Revisions: $50 if revising to earlier start and submitted less than 2 working days before new date No fee required for any other revision submitted to the department. Original Planned Renovation Project or Sub-Project notification: $100 for original planned renovation project notification. $50 for sub-project when submitted less than 2 working days before sub-project start. No fee for sub-project submitted 2 working days (4 days postal) or more before sub-project start. U.S. Postal Service delivery is not allowed for notices submitted less than 4 working days before start date.

159.20 Abatement Notification REQUIRED CONTENT OF NOTIFICATION. 1. Unique company project number 2. Facility type and name, address, and contact person with phone # 3. Abatement type: removal, enclosure, encapsulation, or repair 4. Facility occupancy status: occupied or vacant 5. Notification type: original, revision, cancellation, planned renovation or sub-project 6. Abatement schedule: start/end dates, work days and hours 7. Any pre-project inspection dates, inspector name and DHS certification # 8. Asbestos company name, DHS certification #, address, and contact person with phone # 9. Amount and type of asbestos involved in project 10. Signature of company representative with date

159.20 Abatement Notification NOTIFICATION FOR PLANNED RENOVATION. A planned renovation project is a renovation in a facility during which a number of asbestos abatement activities are expected within a certain time period. Notification may be for a time period of up to 12 months when expect multiple sub-projects to involve asbestos abatement. Under a notified planned renovation, notifications must still be submitted for each abatement sub-project. Notification for sub-projects must include the following: 1. Company project number for the planned renovation. (from the original planned renovation notification) 1. Sequential number of the sub-project. 2. All other relevant abatement activity information…
