1 Executive Summary Positive Prevention HIV/AIDS Education Program In order to be compliant with Ed Code sections 51930-51939, Lodi Unified School District must: Implement a compliant HIV/AIDS Prevention Education curriculum in middle and high school. In LUSD the changes include: – Passive (not active) parent/guardian permission – Materials will follow state compliance guidelines – All 7 th and 9 th grade students will receive HIV/AIDS prevention education – Instruction to include abstinence plus information on the manner in which HIV/AIDS is and is not transmitted Revise school board policies 6142.1 and 6142.2 to reflect changes in the law pertaining to HIV/AIDS prevention education.

3 Authorized vs. Required Education EC 51933 “School districts may provide comprehensive sexual health education…in any kindergarten to grade twelve, inclusive…” (authorized). EC 51934…all pupils in grades seven to twelve, inclusive, receive HIV/AIDS prevention education…at least once in middle school and at least once in high school. (required). EC 51934 (3) Abstinence may be taught within the context of HIV/AIDS prevention education however, abstinence-only education is not permitted in California public schools.

4 Why Revise LUSD HIV/AIDS Prevention Education? LUSD must be compliant with current Education Code. State requires Abstinence “Plus” Education (the plus being outlined in this presentation). District must have a consistent and uniform HIV/AIDS curriculum in all Middle and High Schools. Current LUSD Board Policy must be revised to align with State Education Code.

6 Purposes of the Law: EC Section 51930 – To provide a pupil with the knowledge and skills necessary to protect his or her sexual and reproductive health from unintended pregnancy and sexually transmitted diseases. – To encourage a pupil to develop healthy attitudes concerning adolescent growth and development, body image, gender roles, sexual orientation, dating, marriage, and family.

8 Education Code 51931 Comprehensive Sexual Health Education is education regarding human development and sexuality, including education on pregnancy, family planning, and sexually transmitted diseases.

9 Education Code 51931 (continued) HIV/AIDS Prevention Education is instruction on the nature of HIV/AIDS, methods of transmission, strategies to reduce the risk of human immunodeficiency virus (HIV) infection, and social and public health issues related to HIV/AIDS. HIV/AIDS prevention education is not comprehensive sexual health education.

10 Education Code 51931 (continued) Medically accurate means verified or supported by research conducted in compliance with scientific methods and published in peer-reviewed journals, and recognized as accurate and objective by professional organizations.

12 Education Code 51933 (d) (1) Instruction and materials may not teach or promote religious doctrine. (d) (2) Instruction and materials may not reflect or promote bias against any person on the basis of any category protected by EC Section 220. – (sex, ethnic group identification, race, national origin, religion, color, mental or physical disability, or any actual or perceived characteristic defined in hate crimes.)

13 Education Code 51933 California state law requires that HIV/AIDS prevention education is taught in middle school and in high school.

14 HIV/AIDS Prevention Instruction Must Include: 1. Information on HIV/AIDS and how it affects the body. 2. How HIV is and is not transmitted, including information on high-risk activities (EC 51934).

15 HIV/AIDS Prevention Instruction Must Include: (continued) 3. Discussion of ways to reduce the risk of HIV infection: a. Instruction shall emphasize sexual abstinence, monogamy, avoidance of multiple sexual partners, and abstinence from intravenous drug use. b. Instruction shall include the latest statistics on the success and failure rates of condoms and other methods of contraception to prevent sexually transmitted HIV. c. Information on other methods that may reduce the risk of HIV transmission from intravenous drug use (EC 51934).

Development of refusal skills and effective decision-making skills to assist students in overcoming peer pressure and to avoid high- risk activities. 7. Discussion about societal views on AIDS, including stereotypes and myths regarding persons with AIDS and emphasizing compassion for people living with HIV/AIDS.

18 Requirements for Instruction 1. Instruction and materials shall be age appropriate. 2. All factual information presented shall be medically accurate and objective. 3. Instruction shall be made available on an equal basis to pupils who are English Learners (EC Code 51933). 4.Instruction and materials shall be appropriate for use with pupils of all races, genders, sexual orientations, ethnic and cultural backgrounds, and those with disabilities.

19 Requirements for Instruction (continued) 5. Instruction and materials shall be accessible to pupils with disabilities, including, but not limited to, the provision of a modified curriculum, materials and instruction in alternative formats, and auxiliary aids. 6. Instruction and materials shall encourage a pupil to communicate with his or her parents or guardians about human sexuality. (EC Code 51933).

20 Positive Prevention HIV/AIDS Program Positive Prevention is a comprehensive (two week) curriculum designed to provide California adolescents with the information and support they need to choose behaviors that reduce their risk of becoming infected with HIV which causes AIDS, and related STD’s Positive Prevention is a collaborative project of the American Red Cross, the CDE, and the California Department of Health Services

21 Positive Prevention Curriculum Available at four levels : – Level A: Middle School or Junior High-age students – Level B: High School-age students – Special Population (for moderate and lower functioning special needs students – Independent Study – Packet of homebound or non-traditional students
