Sullivan Report 2007 – Low Carbon Building Standards for Scotland – Practical performance standards for existing buildings Importance of building carbon footprint – greater significance as Carbon Reduction Commitment (CRC) is on its way!!

The Energy Performance of Buildings (Scotland) Regulations 2008 Definitions - which, when, who - affects owners, occupiers, prospective buyers or prospective tenants Format and Methodology of Energy Performance Certificates – Asset Rating Requirement in Scotland Approved organisations – membership, competence etc Sale or rent – EPC must be made available to prospective buyer or tenant Display of energy performance certificates – Public Building Owner or Occupier, >1,000m2 institution providing public services and can be visited by public

Scotland Regs Cont Registration of certificates – must be registered but only a register at present for existing dwellings Enforcement authorities and the power to require production of energy performance certificate – Every Local Authority is an enforcement authority Penalty charge notices issued by LA, -£500 dwellings £1,000 in any other case Defence where energy performance certificate unobtainable - demonstrate that a request was made at least 14 days prior to when the certificate should have been required

EC Legislative Resolution Recast of 2002 EPBD Legislative Resolution voted on 23 April 2009 Public Sector to take more of a lead role Acknowledges existing limitations - building savings potential remains unexploited Role of improvement recommendations strengthened, Public authorities shall implement recommendations within validity period Buildings frequently visited by the public - 250m2, all buildings occupied by public authorities

Continued All new buildings net zero energy design by Dec 2016 Major renovations – min energy efficiency performance standards - encourage use of renewables, cogen, district heating Smart meters must be installed in all new buildings and all buildings undergoing a major renovation More robust accreditation of energy experts

Continued Independent verification of 0.5% of each experts certificates EPC may for non-residential buildings, if appropriate, also include the actual annual energy that is consumed. A/C and heating inspections and reports more robust EC shall establish by 31 March 2010 a common methodology of calculation of the energy performance of buildings,

Action on Climate Change Scotland Action on Climate Change Consultation – new legislation being considered Assessment of Carbon and Energy Performance (ACEP) even if NO EPC required Non domestic building owners given more robust advice or could be legally required to undertake improvement programmes. View that 10 year EPC validity is too long EPC operational rating in addition to asset rating
