3 Reference legislation framework of reference for actions that promote social inclu In Italy there is a legal/regulatory sion/social accompaniment of people running criminal, particularly when it comes to external criminal execution. No claim to exhaustiveness, some references and regulatory overview can help reflect the project actions that will be presented. These legal notes and references will be preceded by a brief summary of the various forms of execution of the penalty provided for in the Italian Penitentiary Law.

4 Reference legislation: sentence’s form of execution In a nutshell:  Penal execution inside the Penal Institution (regional circuits between Local Homes and Houses of Confinement)  External permissions (family reasons, health, study, etc)  Foreign work permit ex art 21 OP (also valid for study, volunteering, etc)  Alternative measure: home detention  Alternative measure: day release  Alternative measure: probation social services (for drug addicts and alcohol addicts)  “to test” adults  Security measures and arrest

5 Reference legislation : the main reference laws In short the most important regulations affecting social cooperation, external penalty executions and detention in general are:  Law 354/1975 Penitentiary Law  Law 381/91 on Social Cooperation  Law 193/2000 so-called "Smuraglia law”  Recent regulations (decree "empty prison" and l 67/2014)  regional Law 08/05

6 Actions for the social accompaniment in alternative measure : the ARIA project ARIA project, (concluded on 31.12.2013) was aimed at the strengthening of 'access to alternative measures to detention in prison through the development of individual projects of social support / social inclusion, was financed by the Fondazione CARIPLO and Regione Lombardia and was based on three lines of action:  Training and reintegration working accompaniments;  Accompanying measures to the housing rehabilitation (social housing);  Accompanying actions to social reintegration. Specifically, accompanying actions to social reintegration rested on:  Interventions to support education;  Family mediation interventions (upon return to family);  Psychological support (especially in the first phase of access to measurement);  Conflict mediation interventions (at work and at home);  Interventions related to LPU (for traffic violators);  Legal support for foreigners in alternative measure.

7 Actions for the social accompaniment in alternative measure: MAMI’ project MAMI’ project or MAcroprogetto MIlano, (in progress and will end in July) inherited the system of intervention promoted by the action of ARIA system, with several specifications related to the peculiarities of the announcement. The project is funded by Regione Lombardia ex lr 08/05. MAMI’ project based its interventions on 3 points:  Accompanying actions to return to work;  Accompanying measures to the residential rehabilitation (social housing);  Accompanying actions to social reintegration. Specifically, accompanying actions to social reintegration rested on:  Accompanying social actions in the territory made by network Agents;  Accompagnamento e supporto psico-educativo al reinserimento abitativo (housing sociale).

8 Actions for the social accompaniment in alternative measure: TRIO projects In July 2014 will leave in the Lombardy region, actions for people running criminal prosecution that reference the lr 8/05. Actions are financed by Regione Lombardia. Accompanying actions to social reintegration envisaged (for example by TRIO projects active in the Province of Milan) are:  Accompanying social actions in the territory made by network Agents (especially for people at the end of the sentence and foreign prisoners);  Actions of territorial educational support (continuity with the actions of network agents and liaison with regional services)  construction of individual integrated and synergistic projects by the case manager (multidimensional interventions and alternative measures)  Shares of psycho-educational support for fragile detainees (sex offenders e therapeutic continuity for people with psychological problems)  Awareness-raising actions (theater and public utility projects)

9 Actions for the social accompaniment in alternative measure: The strengths From this quick overview, you can identify the strengths that now characterize system actions in favour of social support for people running criminal proceedings, and which are at the root of their success:  Ability of these projects/actions system to integrate public funds (Regione Lombardia, Local Authorities) with private resources (Banking foundations and Private Social’s co-financing)  Ability of these projects/actions to create an integrated system with already operating public services on the territory (ASL, CPS, SERT, SIL) to develop integrated actions that do not result in duplication.  Ability to offer individual projects to recipients of social rehabilitation of 360 °, for a synchronous management of multidimensional interventions that respond to situations with multi-problems (training / work, home and social support) through the action of specific professionals (case managers or educators network )

10 Evaluation points The analysis of these summary assessments allows to focus on specific points of the Italian situation (and Lombard). in detail:  Today, Italy is providing a series of regulations/actions projects that enhance and facilitate the use of various forms of execution of punishment; the process should be implemented so that recourse to detention in prison remains the extrema ratio.  Several economic measures, especially those that tend to facilitate the recruitment of persons working in penal execution outside, remain precarious work and subject to continuous Refinancings, missing the necessary structure character( see law 193 “Smuraglia”).  The same interventions / actions of system services are not structural, but subject to continuous refinancings that do not facilitate a broader planning.  In purely legal stressed the need to have an attitude that gives continuity to the efforts undertaken in recent months to identify different forms of punishment (community service, public utility projects, repair projects victim/offender, etc)
