3. 1.Lean and Efficient Administration  Arbitration Court is a tightly coordinated group of experienced arbitration practitioners  Same Court members administer the case from beginning to end  Administrative decisions are usually rendered within two business days –Appointment of arbitrators –Control of arbitration costs  Average duration of ordinary proceedings is 14 months 3

4. 2.Expedited Procedure  Art. 42 provides that Expedited Procedure applies: –When chosen by parties –When amount in dispute does not exceed CHF 1 million (GBP 670,000), subject to opt out  Sole arbitrator, single exchange of briefs and single hearing  Enforced time limit of 6 months for award  40% of cases conducted under Expedited Procedure 4

5. 3.Availability of Urgent Relief  Art. 43 provides for emergency arbitrator before constitution of arbitral tribunal –Decision within 15 days –Requirement to commence arbitration within 10 days  Art. 26(3) provides emergency arbitrator and arbitral tribunal may issue ex parte preliminary orders –Only in exceptional circumstances –Other party must be heard immediately –Valuable where no other urgent relief is available 5

6. 4.Cost Control  Arbitration Court approves or adjusts arbitral tribunal’s determination of fees and expenses  Arbitral tribunal’s fees are determined based on: –Amount in dispute –Complexity and time spent –Other relevant circumstances  Administrative costs: –None if amount in dispute is less than CHF 2 million (GBP 1.3 million) –Capped at CHF 50,000 (GBP 34,000) 6
