2  Approximately 12,000 practising in England and Wales  Controlled by the General Council of the Bar (barcouncil.org.uk)  Different routes to becoming a barrister: ◦ Complete the stages of the training flow chart showing the available routes, using the textbook to assist you.

3  Advocacy ◦ Especially in higher courts  Written legal advice  ‘Cab rank’ rule ◦ Cannot turn down a case if it is in the area they deal with and they are free to take the case ◦ Why have this rule?

4  Can someone take their case direct to a barrister?  Originally everyone had to go to a solicitor first (solicitor would then brief barrister)  Bar Direct – some professionals could brief a barrister directly  September 2004 – direct access for all in all civil cases  Still no direct access for criminal or family work.

5  Can apply to become QC after 10 years as barrister or solicitor with an advocacy qualification.  Used to be appointed by the Lord Chancellor  Selection is now made by an independent selection panel after application by lawyers

6  If something goes wrong… ◦ You cannot sue a barrister in contract ◦ You can sue a barrister for negligence Saif Ali v Sydney Mitchell and Co (1980) Hall (a firm) v Simons (2000)  Complain to Legal Ombudsman  Bar Standards Board can deal with complaints about misconduct and disciplinary matters
