WHAT IS COPYRIGHT? An author, composer, publisher, and distributor is given the right to publish, produce, and sale a piece of owned work whether it is published or unpublished.

WHY REGISTER? Makes it easier to recover and sue an infringer. Creates a legal presumption that your copyright is valid. Allows you to recover up to $150,000 without having to prove monetary harm. Before legally permitted to bring a lawsuit and enforce it.

WHERE DO I REGISTER? ONLINE Online registration using Copyright Office (eCO) $35.00 fee for single author $55.00 for any other filings Faster processing time Online tracking status Pay by debit or credit card PAPER Fill-in forms using TX (literary works) *VA (Visual Arts Work) *PA (Performing Arts Work) *SR (Sound Recordings) *SE (Sound Serials) Fee is $85.00 paid by check or money order

WHO NEEDS TO REGISTER? The author of these categories: musical works, including any accompanying words Literary Works Dramatic Works Pantomimes and choreographic works Pictorial, graphic, & sculptural works motion pictures and other audiovisual works Sound recordings Architectural works

WHEN TO REGISTER? As soon as the work has been finalized Your work is protected immediately A certificate of registration is sent to owner of work The protection is for a lifetime, at least 70 years the author’s life span.

FAIR USE AND TEACHER ACT The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes The nature of the copyrighted work The amount and substantiality of the portion used in relation to the copyrighted work as a whole The effect of the use upon the potential market for, or value of, the copyrighted work SECTION 107 FACTORS

TEACH ACT REQUIREMENTS The institute needs to be accredited and a non-profit educational institution. The use needs to be part of mediated instructional activities. The use must be limited to a specific number of students enrolled in a specific class. The use needs to be for “live” or asynchronous classes. The use must not include transmission of textbook materials.
