3 Criminal Records Update – Regulated Activity, a reminder A of a specified nature + C “frequently, intensively and/or overnight” Or B in a specified place* + C “frequently, intensively and/or overnight” + D gives the person the opportunity for contact with Children or Vulnerable Adults

4 Criminal Records Update cont… Removal of ISA registration and continuous monitoring CRB is merging with the ISA to form the “Disclosure and Barring Service” Perceived lack of precision around regulated activity. Looking to reduce the scope of regulated activity. Looking at a new system for continuous updating and portability Going to issue guidance on supervision to help establish if an individual is undertaking a regulated activity Explicitly a risk based approach ESCC won’t receive a copy of the disclosure certificate, the applicant will receive it first and then pass it to us. Volunteers – some examples from the DFE as to when a CRB check would be required –Volunteer “Classroom Assistant” – please record as Parent Helper

12 Employment Tribunal claims  In 2011 ESCC defended 15 claims at Employment Tribunals  6 of these claims were from schools
