2 n Article III: Fundamental rights and principles n Article VII: Any derogation, exemption or flexible application of the Convention requires consultation with shipowners and seafarers organizations u Where such organization is non- existent, the Member State can decide through consultation with the Special Tripartite Committee (Art. XIII) 2

3 n Shipowners have the obligations corresponding to those of the Flag State as show in Appendix B5-I (measures drawn up by shipowner named in the MLC attached to Part II of Declaration) 3
