3 What is DACA? A directive signed by President Obama on June 15, 2012 Temporary reprieve from deportation Does NOT grant lawful immigration status 3 of 9

4 Who is eligible? Age requirements Physical presence requirements Inadmissibility - E.W.I. or visa overstay High school diploma /GED or honorably discharged veteran Certain classes of criminal convictions 4 of 9

5 How is a DACA application filed? Form I-821D Form I-765/WS 2 passport style photos $465.00 Identity/physical presence documents 5 of 9

6 Why file? To become eligible for: ▫Social Security number ▫Two year work permit ▫Driver license (in most states) ▫Travel document (and possibility of AOS) Possibility of program renewal in August 2014 6 of 9

7 What are the concerns? Documenting removability. ▫Applicant and family members Not guaranteed. No appeal process. ▫Can be NTA’d. No pathway to U.S. citizenship. Misrepresentations = enforcement priority 7 of 9
