Berlin Declaration 2 conditions work must be placed in an online repository by proper organisation that seeks to enable open access; licence attached to the work allowing reuse in any digital medium for any responsible purpose; signing not enough: concrete steps needed require researchers to deposit copy work in repository; encourage researchers to publish article in open access journal; provide support to enable that to happen.

author & institution institutions must develop clear, official policy: clear strategy on ownership and management copyright; proactively disseminate policy and supporting information; uphold academic freedom and rights stemming from copyright law.

author and publisher did author give away her copyright? relationship established by publishing agreement; set terms and conditions for publication and accessibility; copyright is bundle of rights which can be managed differently.

licence to publish balance between granting maximum access and financial compensation for publisher; no distinction pre print, post print but stipulation that published version can be disseminated; no delayed open access; embargo exception and up to maximum of 6 months.

principles licence the copyright remains with the author; the author grants the publisher a sole licence to exploit certain rights needed for publishing; the licence comes into effect immediately after the communication with the publisher of his willingness to publish the article; the author deposits the definitive version of the article in the form as it is published in the journal; depositing the article on a publicly accessible institutional repository is immediate after publication of the article in the journal; delayed open access is only possible for a maximum period of six months.

e-deposit licence could combine 2 conditions Berlin Declaration; unrestricted reuse; possibility for interoperability and long-term archiving; elements: non-exclusive; indefinitely; possibility preservation; liability clauses.
