6 Legal and regulatory framework UK Electronic Commerce (EC Directive) Regulations 2002 mere conduit defence, notice and takedown, no obligation to monitor applies to non UK services operating in UK Data Protection Act 1998 defines legal obligations for handling data Regulation of Investigatory Powers Act (RIPA) 2000 defines what data Police can request of service providers

8 Who to report abuse to … Life at risk – call 999 Illegal child abuse images - www.iwf.org.ukwww.iwf.org.uk Suspicious behaviour towards child - www.ceop.gov.ukwww.ceop.gov.uk Abusive content on SN site/forum/chat - site provider Abusive content on website – website or host (lookup via www.dnsstuff.com) Abusive email/spam – sender’s email service provider Malicious/nuisance calls – your phone service provider

9 Reporting abuse to a service provider 1. decide who is the service provider 2. preserve evidence e.g. screen grab 3. contact the service provider’s customer support or abuse team 4. they will review complaint against their T&Cs 5. if breach has occurred content will be taken down and action may be taken against abuser

10 Orange broadband customer abused on 3 rd party site e.g. youtube or myspace Report abuse to 3 rd party – via link on 3 rd party site – or find host using www.dnsstuff.com 3 rd party abuse team can – takedown content in breach of their T&Cs – take appropriate action against abuser – provide details to Police or RIPA approved agent 3rd party abuse team can’t – give out information to anyone else

11 Any Internet user abused by an email from an Orange email address or in Orange hosted site Follow link to ‘report abuse’ from safety or help – get advice eg. ignore user or contact Police – complete webform to report abuse Orange abuse team can – takedown content in breach of T&Cs – take appropriate action against abuser – provide details to Police or RIPA approved agent Orange abuse team can’t – give out details to anyone else

12 Orange mobile customer receiving malicious calls or texts make a note of dates/times, save texts if calling number is known – contact Police or if number not known account holder can contact customer services malicious calls bureau can – offer advice or free change of phone number – identify caller and recover text or voicemails – provide details eg caller’s number, to Police
