2 Community Development Department REQUEST Flagler Home Builders Association- Modification to extend time frame residential units can be used as models. Justification is current housing market; no capital outlay for new units; more cost effective to refresh interiors.

4 Direction: Community Development Department Dept. - Model Home valid seven years from Certificate of Occupancy; garage must function as such prior to sale. PLDRB recommends no change to LDC (5 years), but allow models in existence to receive 5 year time extension; concur with garage provision. New expiration date for existing models = January 1, 2016.

5 Community Development Department Recommendation- Change Duration of Use A residential dwelling unit may be used as a model for a maximum period of five (5) years from the date the certificate of occupancy is issued. Any residential dwelling unit legally permitted as a model as of the effective date of this Ordinance shall be permitted to remain as a model home until January 1, 2016. Prohibited Activities: A model home shall not: »Be used as a primary or secondary office for a homebuilder or real estate agent with regard to conducting business activities outside of those permitted above. »Be used for storage of building materials. »The garage of the model home may be used as an office for sales staff if separate off-street parking is provided. »The garage must be equipped with a standard garage door, unless dedicated off-site parking is provided, excluding rights-of-ways. »If the space for the required garage has been converted to space for purposes other than a garage, the space must be converted back to a residential garage and equipped with a standard garage door prior to the sale and use as a dwelling unit.
