Localism Act 2011 Community Right to Nominate
opportunity to nominate an asset (building/land) listed by the local authority as an Asset of Community Value

What does it mean to you Should a listed asset come up for disposal it provides: Six month delay in the disposal process (moratorium) to allow the nominating/community group time to prepare a proposal to raise funds to purchase the asset at market value

Key facts there is no obligation for the nominating/community group to make a bid the owner is under no obligation to sell to the nominating/community group the owner can sell to the nominating/community group within the six month moratorium period

Assets defined The Act defines an eligible asset in terms of:
Purpose – use in the past present and future not the nature, historical or architectural merit Location – within the local planning authority area Ownership – all ownership whether private or public, single or multiple owners

Community value Furthers the Social wellbeing, cultural, recreational or sporting interests of the local community currently previously potentially in future

Types of assets Could include: Parks and open green spaces
Sports and leisure centres Libraries Community centres Town, civic and guild halls Pubs Village shops Public toilets

Who can nominate Must demonstrate local connection
Town and Parish Councils unincorporated bodies with at least 21 local members community interest companies charities

The process nomination – nomination form validation and decision- eight weeks inclusion on the Asset of Community Value List for five years

Disposal interim moratorium – 6 weeks Decision to bid:
decision to bid/not to bid Decision to bid: moratorium – 6 months the owner is not allowed to sell the asset during this period the community group have time to raise the funds to purchase the asset

Review and Appeal Review
the owner has the right to request a review against the listing decision review must take place within – eight weeks Appeal the owner has the right to appeal against the review decision to the First Tier Tribunal
