5 European Federation of Waste Management and Environmental Services Revision of the Public Procurement Directives/New Concessions Directive December 2011: Commission proposal for the revision of the public procurement Directives and for a new Directive on service concessions Current discussions in EP IMCO Committee Proposals expected to be adopted by the end of 2012

6 European Federation of Waste Management and Environmental Services Revision of the Public Procurement Directives/Concessions Directives FEAD calls for: Activities in the open market, transparency and level playing field between public and private companies Stricter rules concerning public-public cooperation and exemptions from the scope of the Directives - the proposed rules should be strengthened and not watered down during the co-decision process The price should never be the sole awarding criterion Strengthening of the requirements on green public procurement, leading to greater Resource Efficiency

7 European Federation of Waste Management and Environmental Services Resource Efficiency September 2011: EC published the Roadmap to a Resource Efficient Europe February 2012: The EP published its own initiative report on a resource efficient Europe (rapporteur MEP Gerbrandy – ALDE) Autumn 2012: EC proposal for a 7 th EAP End of 2012: EC Communication on the review of the SCP-SIP Action Plan

8 European Federation of Waste Management and Environmental Services Resource Efficiency FEAD key recommendations: Better dialogue between producers’ and recyclers’ sectors Extension of Eco-Design Directive to cover material RE of key products Development of Ecolabels identifying recycled material content of products Strengthening the producer responsibility principle and encouraging the use of IPR Reduction of VAT rates to promote secondary raw materials Encouragement of separate collection of food waste and setting of food waste prevention targets Better implementation of the waste acquis can lead to greater RE  10 May 2012: FEAD-BDE seminar„Moving up the Waste Hierarchy – Best Practice Examples”

9 European Federation of Waste Management and Environmental Services Implementation of the Waste Framework Directive The WFD was due to be transposed in December 2010 Beginning of 2012: Reasoned opinions have been sent to 13 MS, concerning the transposition of the WFD 26 April: EC announced the referral of Poland, Hungary, Slovakia and Bulgaria to ECJ for failing to transpose the WFD 2012: Detailed conformity assessment of the transposition of the WFD in the MS by DG ENV

10 European Federation of Waste Management and Environmental Services Implementation of the WFD/Transposition in Hungary End of 2011: Hungary notified a new draft law to the EC, DG ENTR, intended to transpose the WFD This law would violate basic European internal market freedoms: Infringement of the freedom of establishment Violation of the right to property, as stipulated in the European Charter of human rights Infringement of the free movement of goods Violation of EU competition rules 30 March 2012: End of standstill period – detailed opinions sent by Austria, Germany, France – Comments by DG Enterprise FEAD actions against the Hungarian draft law: March 2012: FEAD comments were filed to DG MARKT, COMP, REGI, ENV, ENTR

11 European Federation of Waste Management and Environmental Services Cohesion Policy European Commission October 2011 – Presentation of the proposal for the next funding period European Parliament 6 March 2012 - FEAD EP breakfast meeting 19 April - Presentation of the draft report on Cohesion policy Regulation (final version expected 29 May) July - Adoption of EP Report on CPR in REGI Committee September –Adoption of EP report in plenary Council Mid April and end of June - General Affairs Council discussion on Cohesion Policy package  The proposals are expected to be adopted in the course of 2013 along with the 2014-2020 MFF

12 European Federation of Waste Management and Environmental Services Cohesion Policy Shortcomings of the current Cohesion Poliy: Funding focus on waste treatment infrastructure at the lower end of the waste hierarchy – paradigm shift will contribute to a better compliance of Member States with the different targets of EU waste legislation (i.e. recycling targets, landfill diversion targets etc.) Low absorption rate of the available EU funding FEAD is concerned that the EP and Member States will water down the EC proposal for the introduction of an ex-ante conditionality, according to which the European funds should be allocated to projects that respect and promote the waste hierarchy.

13 European Federation of Waste Management and Environmental Services Revision of the Waste Treatment BREF Adoption of the IED (Industrial Emissions) Directive in 2010: BREFs (Best Available Techniques Reference Documents) will become legally binding in the future – impacts permitting conditions; Extension of the Directive‘s scope to certain recycling activities (treatment in shredders of metal waste, including waste electrical and electronic equipment and end-of-life vehicles and their components). Modifications of the ‚Seville‘ approach with the new IED: Enforced role of national authorities in the selection process of reference plants (i.e. selection of reference plants per Member State); FEAD position: Ensure that ELVs remain feasible by setting the ELVs at the average level of both, best and worst performing installations, and not at the level of just the top-performers; FEAD activities: Preparation of the revision of the Waste Treatment BREF; expected to start end of 2012/2013;

14 European Federation of Waste Management and Environmental Services Shipments /waste inspection criteria/Fact finding Illegal shipment of waste under the “re-use” label - a key concern for European industry and society; Need to distinguish between an unintentional administrative breach of law and criminal illegal shipments of waste; Member States: Greater commitment and financial resources required in order to limit illegal shipments; FEAD welcomes the future EC proposal on waste inspection criteria and stressed the need for the EC to focus on identifying actual criminal activities, i.e. illegal shipments of waste.

15 European Federation of Waste Management and Environmental Services Other important on-going issues Proper enforcement of REACH and CLP (Classification, Labelling, Packaging) regulations; R1 energy efficieny formula for municipal waste incinerators and climate correction factor; Revision of the Landfill Directive; Revision of the List of Waste.
