10. Legal Information// Marriage License A valid wedding license obtained from a Georgia Probate court is required and must be presented to the judge prior to the ceremony. Family and friends are all welcome. For parties desiring to hire an official to perform a wedding ceremony apart from the courthouse, Georgia law gives parties the legal authority to contract with an “off duty” judge or other official authorized by law, to perform marriage ceremonies. Please see the form entitled, ‘Wedding Request, MAG 25-02, if you are interested in that service. You will need to go to the Probate Court in the county where either the groom or bride resides. If neither the bride nor the groom is a a resident of the state of Georgia, then they should go the Probate Court in the county where the wedding ceremony is going to be performed. You will complete the form, #3905, which is the Application for Marriage License document. Because completing the form requires that you be administered an oath by the clerk of Probate Court, both the bride and groom should appear before the clerk to get the marriage license. You will be required to complete all the information on the form to the best of your knowledge. Do not sign the form until the clerk administers an oath. There is another application supplement, form #3953, which also must be completed. The questions on both of these forms are directed to both the bride and groom.
