7  In contracting with DoD Agencies and subcontracting with DoD Primes small businesses (SBs) and Non-Profit Agencies (NPAs) are required, like any other contractor, to comply with the requirements of the Federal Acquisition Regulations (FAR), Defense FAR Supplements (DFAR), Public Law and Executive Orders.  As an example, MVLE has received a subcontract that requires certifying to:  Export Control (ITAR/EAR)  Affirmative Action (FAR 52.222-25)  Equal Opportunity (FAR 52.222-22) and EEO Pre-Award Compliance (FAR 52.222-24)  Certificate Regarding Responsibility Matters (Far 52.209-5)  Certification of Toxic Chemical Release Reporting (FAR 52.223-13)  Certification And Disclosure Regarding Payments To Influence Certain Federal Transactions (Far 52.203-11) The challenge to Small Business (SB) and NPA’s

8  On many of its subcontracts MVLE is required to Certify Cost and Pricing data, Truth in Negotiating (TINA) (USC § 2306a), Procurement Integrity(41 U.S.C. §423, implemented at FAR 3.104), and Contractor Code of Business Ethics and Conduct (FAR 52.203-13)  SB/NPA’s operate with low overheads. We tend to be “one deep” at every position.  Large Business has the “luxury” of strong compliance organizations including:  Ethics and Standards  In House Law Department and Access to Outside Counsel  Export and Import Management Office The challenge to Small Business (SB) and NPA’s

10 What has being a protégé to Northrop Grumman brought in the way of a solution…..  Northrop Grumman shares (with all suppliers) it’s Standards of Business Conduct handbook, which is a strong statement of the Northrop Grumman values and their expectations that all small businesses live up to those same values.  Mentoring in such compliance issues as cost and pricing data,  Access to professional organizations like DII, AIA, and Government DCMA

11 Other Resources  MVLE currently has eLearning training programs utilizing ELITE.  MVLE also has obtained training from other sources
