Objectives: 1) Participants will become familiar with General Supervision Monitoring Plan Section of the Kansas Infant Toddler Services Procedural Manual. 2) Participants will understand that the Kansas Infant Toddler Services Procedure Manual is the modus operandi (way of doing business). 3) Participants will understand the Kansas Infant Toddler Services Procedure Manual is based on state and federal law and regulations. 4) Participants will understand expectations for use of Kansas Infant Toddler Services Procedure Manual.

34 CFR Section 303.700 – Regulation requiring the state lead agency (KDHE) to: Monitor implementation of IDEA Make annual determinations for each EIS program Enforce the regulatory requirements Report annually on the performance of the state and each EIS program.

The state monitoring focus is directed to be primarily on: Improving early intervention results and functional outcomes for infants and toddlers Ensuring EIS programs meet program requirements under Part C

The state must use quantifiable indicators and measures needed to measure the priority areas of: providing services in the natural environment, and general supervision, including child find, monitoring, mediation, and a system of transition services.

All actions and activities related to general supervision under the federal regulations are used for: collecting data, monitoring programs, Federal reporting, issuing local determinations, finding and correcting noncompliance, reviewing grant applications, and providing technical assistance during the next fiscal year

A finding of noncompliance is an official citation of a regulatory violation, which may or may not be related to a compliance indicator on the SPP/APR. Findings must be issued in writing, but no later than three months after a confirmed determination of noncompliance. A “finding and release” may be issued if the noncompliance found is not seen in a review of data subsequent to the annual review period. This is still a finding, and will be part of the next year’s determinations.

A CAP may be used as a method for correcting the noncompliance in the finding. Requirements of the CAP depend on whether the noncompliance: was extensive or found in a small percentage of files, resulted in the denial of a basic right under IDEA, represented an isolated incident in the program, or reflected a long-standing, or repeated, failure to meet the IDEA requirements

Under federal regulations, the state is required to report to the public on the performance of programs funded by Part C. This includes the SPP/ APR, the SAR data sheets, and the status determinations. This information appears on the Kansas ITS website.
