Districts must have on-site access to appropriate resources to achieve a high school diploma, a modified diploma, an extended diploma or an alternative certificate at each high school in the school district or public charter school. 13 Special Education HB 2299 Makes school district where charter school is located responsible for SPED services Distributes state funding to district Establishes timelines for interdistrict and parent notice requirements Adds IEPs to non-discriminatory requirements Effective July 1, 201

14 Special Education HB 2939 Prohibits use of mechanical restraints, chemical restraint or prone restraint Allows use of physical restraint or seclusion under specific circumstances Directs Department of Education to approve training programs in physical restraint and seclusion. Operative July 1, 2012

15 Policy Shifts SB 290 Directs State Board to adopt core teaching & administrator standards Directs school boards to include core standards for evaluations of teacher and administrators on and after July 1, 2013 HB 3474 directs TSPC to also adopt performance standards to used during 2012-2013 school year

District may limit number of students District may not discriminate based on race, religion, sex, sexual orientation, ethnicity, national origin, disability, terms of an individualized education program, income level, proficiency in the English language or athletic ability. District may continue to use other forms of interdistrict transfer Sunsets July 1, 2017 but students remain at district

20 Education Service Districts SB 250 Allows school districts to withdraw from certain ESDs Requires ESDs to pass through 90% of ESD formula revenue and local revenues to districts that withdraw. Requires ESDS to continue for 2011-12 school year pass through moneys at same percentage or more as in 2010-2011 Reduces the share of total formula revenue that is distributed to ESDs from 4.75% to 4.5% Creates Office of Regional Educational Services within ODE

21 Education Service Districts SB 27 Requires ESDs to submit annual audit to ODE HB 2280 Allows ODE or Secretary of State to initiate audit of ESD or school district

22 Charter Schools HB 2029 Applies state laws relating to student education records to charter schools Requires transfer of student education records to school district when charter school closes

23 Charter Schools HB 2301 Repeals 50% Rule Allows districts to limit total district enrollment in virtual charter schools not sponsored by the district to 3% When district has 3% of total students enrolled at virtual charter school not sponsored by the district, students may appeal to State Board if denied enrollment by district Adds restrictions to virtual charter school board members and employees

24 Charter Schools HB 3362 Allows charter schools to enter into cooperative partnerships with sponsor and other districts Allows these schools to have less than 25 enrolled students

25 Charter Schools HB 3417 Charter schools must have budget and accounting system compatible with sponsor system Separates State School Fund calculations to district & charter school

26 Charter Schools HB 3645 Adds Institutions of Higher Education as possible sponsor Proposals submitted to districts and denied may choose to approach institution of higher education to sponsor or appeal to State Board of Education An institution of higher education may not become a sponsor of charter school operating prior to 2012-13 Effective July 1, 2011 – July 1, 2017 (5-yr sunset)
