3 Need for SDI Terms of Use The Extraction by Suction - Scenario This scenario was presented by a regional content provider -Data was published by open services -Commercial usage of the data was not allowed -Nevertheless: -When services were down a telephone call reached the provider -A commercial data provider asked for what reasons the services are down -Because they have to update their databases. -The implemented loop that gathers the information tile by tile has stopped

4 The Extraction by Suction – Scenario -The regional content provider was flabbergasted and asked for the contract that allows the commercial use of the information. -What kind of contract? -They met in court again. Need for SDI Terms of Use

5 Joint Project 2004 – technical driven approach Build an operational standardized core of the SDI 40 Projects were realized to implement: More than 120 services and about 20 applications Need for SDI Terms of Use The SDI Joint Project 2004 - Developments and Experiences

6 Experiences: During the technical realization we have recognized the demand for the realization of economic tasks within the SDI. Arising question: What are services of an SDI good for, if nobody knows if one is allowed to use them in a commercial manner? Answers: Creation of the SiG geo-eBusiness (open) Design of a new Joint Project 2005 whereas the declaration of Terms of Use is demanded for all services Need for SDI Terms of Use The SDI Joint Project 2004 Developments and Experiences

7 Risk: New Barrier We recognize that we need Terms of Use to enable the economic use of the SDI. We also recognize that each content provider has his own comprehension of contracting, licensing, terms of use, costs etc. The risk of about 40 Terms of Use arose Therefore a reasonable organizational structure has to be found to conquer the possible barrier

8 Approach: Conquer the Barrier Harmonization of Terms of Use within the SDI Hope: Harmonization and an enhanced market transparency by usage of a neutral third party template How can hope be changed in reality? Install an organizational structure with active and qualified persons!

9 Organizational structure Different Layers are implemented: GDI NRW – Base of more than 100 Members Realize requirements for SDIs Joint Project 2005 – Build up the SDI Enlarge operational SDI Core and create economic rules Working Group – Terms of Use Apply and discuss Terms of Use template Task Force – Terms of Use Create Terms of Use template operational strategic inductive deductive

10 Approach: Model ToU consists of separate statements referring to elementary combinations of –an operation (What kind of usage is undertaken?) –an intention (What is the purpose of the usage?) Building up a matrix of generic operations / intentions –Ambition: chosen categories should be applicable for data, services and applications!

16 more on operations operations –exakt meaning depends on type of SDI resource (data, services, applications) –documentation of template must comprise adequate definitions in process

17 more on intentions Intentions –different types are highly correlated with specific segments of SDI users, but not synonymous! –e.g. public authorities or educational institutions can act as a company as well knowledge of user segment is not sufficient for the awareness of the intention –therefore neutral terms were chosen for the categorization of intentions

18 optional: request for additional exemplars (JP) Harmonization of ToU: using the template assign exemplars to SDI resources (Joint Project 05) create template (Task Force) feedback (Working Group) hardening the template (TF) definition of ToU exemplars (TF) work out doumentation / instruction sheet (TF) current step forward template and exemplars to members of Joint Project 2005 (TF) dec. 2005 ! one for each reappearing set of legal / economical determining factors establish GDI NRW standard for ToU 2006

19 Outlook Realize a usable, reasonable and simultaneously harmonized SDI Terms of Use template / exemplars. Convert it in proof defined General Terms and Conditions for SDIs. Create a broad and stable base of awareness for the Terms of Use template. Integrate the Terms of Use template technically into the SDI. Activate business processes on the SDI.

20 Conclusion Beside the technical requirements of standardization exists the need for the standardization of economical rules for SDIs. Economical rules are the definite and legal formalized descriptions of the usage of services, data and applications of SDIs. Harmonization process has started in NRW. First results are encouraging but there is still a long way to go.
