Catherine Klein David McQuoid-Mason Elida Nogoibaeva Leah Wortham GAJE-Valencia July 2011 Mainstreaming Human Rights & Justice Concerns in the Law Department Curriculum
2
A bit of background Why this topic was presented to a conference of teachers in the OSI Academic Fellows program involving young teachers from the former Soviet sphere Similarities & differences to this audience
3
In which categor(ies) do you fall? Teach a [international] HR course (substantive law, mechanisms) Teach in a clinic focusing explicitly on HR Teach in a clinic that does not now talk about HR law Teach a substantive law course in the “main” curricululm
4
Differing Legal Education Traditions Those focusing primarily or exclusively on existing law without considering policies behind, what it should be, & consequences – No focus in core curriculum substantive courses on conformity with international HR standards US courses generally emphasize policy & some consequences but not necessarily justice concerns & rarely conformity to HR standards
5
Ultimate question What we want students able to do and motivated to with regard to respect for human rights & concern for justice It’s not what we teach. It’s what they learn.
6
Why “mainstreaming”? Avoid marginalization—not the “real curriculum” Implementation entwined with areas other areas of law, e.g., civil law, criminal procedure, company law Specialists in other fields can add the nuance of those applications Not a substitute for foundational courses in human rights & defining justice
7
Similar mainstreaming issues General justice concerns Legal ethics/professional responsibility Legal skills European law
8
Not our central focus today Degree of truth in the described difference in legal education traditions & why it exists Why we care about the student goal of ability & motivation to act with regard to HR How we would persuade our faculties generally to implement HR concerns throughout the curriculum (but will discuss a bit at the end if interest & time)
9
Today’s Plan Quick list of HR AUCA law department HR integration example Divide into groups Small group discussion Reports (maximum 5 minutes per group) If time & interest: how would you encourage your law school to integrate HR concerns throughout the curriculum?
10
Small Group Focus Examples of what integrating a HR point/teaching objective(s) in the “regular curriculum” might look like Use resource people in group who teach HR or have already integrated
11
What do we mean by HR? Brainstorming Identify things that the group believes to fall within human rights
12
Integrating HR in the curriculum American University of Central Asia example
13
A HR definition Rights & life–sustaining entitlements to persons guaranteed by law and duty of government to conform, observe, apply and protect rights or fundamental principles of democracy, social justice & security in society (state) or limitations of state power or
14
A HR definition human dignity or natural rights (as human beings) or national and international [mechanisms] guarantees for human beings protection/remedies.
15
Small Group Task Appoint a reporter Identify course(s) that one or more of you teach that do not now integrate HR Identify a HR point/teaching objective(s) to be incorporated in that course Use resource people in group who teach HR or have already integrated What teaching methods would you use to integrate the HR component?
