Eligibility 3 Establishes 12-month eligibility redetermination period regardless of changes in income Income must not exceed 85% of SMI Regardless of temporary changes in work, training, or education activities. Prevents E&D process from disrupting parental employment States have option of terminating assistance prior to redetermination (3 month continuation) Graduated phase-out of assistance Requires procedures for enrollment of homeless children; promote access for homeless families

Criminal Background Checks FBI Fingerprinting 4 Applies to all child care providers (except relatives) FBI Fingerprinting: Conducted for all staff in all programs that are participating in a subsidy program Anticipate 5 year renewal; no guidance as yet from federal Office of Child Care Option of ‘wrap-back’ for additional fee Fingerprints have one use – no cross agency sharing All providers, staff, some volunteers required enrollment in Criminal Background Registry Covers those not directly caring for children, but have unsupervised access Cost – states are allowed to charge fees

Health & Safety Standards 5 Basic health & safety pre-service training for licensed- exempt programs States must develop health & safety standards in 10 areas: Prevention & control of infectious diseases Prevention of sudden infant death syndrome Administration of medication Prevention/response to food and allergic reactions Building and physical premises safety Prevention of shaken baby syndrome/abusive head trauma Handling and storage of hazardous materials Emergency & Disaster Preparedness Appropriate precautions for transporting children First Aid and CPR

Monitoring of License-Exempt School-Age Programs At least one annual unannounced inspection of program facilities and records Only programs that participate in the CCDF subsidy programs Employment Related Day Care (0-11) or up to 17 for children with disabilities Teen Parent/Child Development (0-5) Alcohol and Substance Abuse (all ages) Migrant and Seasonal Farmworkers (0-12) Inclusive Child Care Supplemental Payments (0-17) 6

Monitoring 7 Monitoring tool and review areas in development Tool will include: Are facilities meeting health and safety standards Includes an Emergency & Disaster Preparation plan; records show it has been practiced Are all required staff and volunteers enrolled in Criminal History Register Have all staff completed basic Health & Safety training

Consumer and Provider Information 8 Law expands information that states must make available to consumers Website that describes process for licensing & monitoring both licensed and license- exempt child care providers/conducting background checks Results of monitoring and inspection reports; number of deaths, serious injuries, substantiated child abuse National website and hotline for reporting child abuse and neglect Links to states to report violations of health and safety standards
