Computer crime Attacks occur frequently Successful attacks are common Most victims don't know they've been attacked or that the hacker gained access (was successful) Those that do know don't tell anyone for fear of losing customer confidence which translates to the bottom line if stock prices fall.

What is computer crime US Federal computer crime statutes: 18 USC, Chapter 47, Section 1029 Section 1030 Are known as the “Computer Fraud and Abuse Act of 1986.”

Section 1029 Prohibits fraud with PINs, credit cards, account numbers, and electronic identifiers. Nine areas covered interstate or foreign commerce. knowingly and with intent to defraud Penalties 10k-50k fines and or 10-15 years in prison. double for repeat offences

Section 1030 Prohibits unauthorized or fraudulent access to government computers solely concerned with computers U.S. Secret Service and FBI explicitly given jurisdiction to investigate offenses defined under this act. six areas covered Penalty: Fine and/or up to 1-5 year(s) in prison, up to 10 years if repeat offense.

Victim Make backups of damaged or altered files Maintain old backups to show status original Designate one person secure potential evidence Tape backups and printouts initialed by the person obtaining the evidence Evidence retained in locked cabinet with access limited to one person. Keep a record of resources used to reestablish the system and locate the perpetrator.

Testifying you may be testifying as a victim or witness Cases: civil = lawsuit, criminal = government Evidence: physical, direct, intangible when you testify: first hand (not something you heard) speak to the jury (not just to attorney) ask for clarification if you don't know say so don't "talk down" to the jury (DNS DSL)

Opposing attorney don't take it personal answer calmly remain professional at all times if you get angry or speak inappropriately contempt of court fined jailed wait for questions (say nothing to statements) only answer the question (don't volunteer to "explain" anything) stick to "just the facts" if question improper pause (for objection)

Testifying meet with prosecutor ahead of time won't tell you what to say advice on how to say it know exactly when evidence left your hands and who it was given to establishes chain of custody: record of where evidence was and who had control of it from time collected until time presented in court give only facts not opinion
