Graduate Transfer - History Legislation adopted in 1981 permitted post baccalaureate participation at the same institution. 1996 legislation allowed competition for graduate students that transfer and eligible to use the one-time exception. Intentional choice of graduate school, one-time exception.

Graduate Transfer – History NCAA Proposal No. 2005-54. Adopted in April 2006. Allowed student-athletes that complete their degrees ability to compete without NCAA transfer restrictions.

Graduate Transfer – History Overridden in January 2007.

Graduate Transfer – History Proposal No. 2010-52. Adopted in April 2011. Allowed limited subset of student-athletes the ability to transfer and compete immediately.

Graduate Transfers – Current State Must be enrolled in a graduate or professional school. Must be a regularly enrolled, degree-seeking student. Not required to be in a specific degree program. Bylaws 14.1.1., 14.6.1 Staff Interpretation March 15, 2013

Graduate Transfers – Current State What’s the difference between degree-seeking student and being in a specific degree program? Generally, the former is an application or admissions classification. The latter is a degree declaration.

Degree-Seeking but Without Specific Degree Program

Graduate Transfers – Current State Conditionally admitted students. Must be considered degree seeking. Considered to be in good academic standing as interpreted for all students.

Graduate Transfers – One-time Transfer Exception Must fulfill the conditions of the one-time transfer exception and have eligibility remaining.

Case Study Jeremy Jamm, attended Eagleton College in his first semester, however they discontinued wrestling. He subsequently transferred to Pawnee University and graduated. Jamm would like to attend the dental school at Tammy College and complete his final season of competition.

Case Study May Jamm use the one-time transfer exception and be immediately eligible at Tammy College if he previously used the discontinued- nonsponsored exception when he transferred to Pawnee?

Exception to the One-time Transfer Exception Student-athletes in sports without the one-time exception may be eligible immediately if: Student-athlete fulfills all other elements of one-time exception; Has a minimum of one season remaining; and Previous institution does not renew his or her athletically related financial aid.

Exception to the One-time Transfer Exception Previous institution does not renew his or her athletically related financial aid. Nonrenewal is not required to occur prior to indication of wish to transfer.

NCAA Committee on Legislative Relief (CLR) Graduate Transfer Directive

CLR Graduate Transfer Directive No change. Guidelines: Documentation student-athlete (SA) has been accepted into a specific graduate degree program. Documentation indicating the specific graduate degree program is not available at previous institution.

CLR Graduate Transfer Directive Statement from SA detailing reasons for transfer. Statement related to SA’s status on team at previous institution. Statement from administration at previous institution with its position on waiver.

2-4-4 Nonqualifier Attends a two-year college. Transferred to a four-year collegiate institution for one quarter. Transfers to a Division I institution. Is this a simple 4-4 one-time transfer?

2-4-4 Nonqualifier No, SA must have completed the appropriate two-year college transfer provisions prior to enrollment in the first four-year institution.

2-4-4 Nonqualifier May not circumvent two-year college transfer provisions by attendance for less than one academic year at a four-year institution.

Suspension/Dismissal Attends four-year institution for two semesters. Wants to transfer to your Division I institution. You send out the tracer form and when it comes back it says: Was dismissed from the team during the spring term for disciplinary reasons.

Suspension/Dismissal What do you do? Nothing, we don’t have any rules about disciplinary suspensions, do we? Throw the tracer away and tell the coach he can’t come because he was dismissed for disciplinary reasons. Follow-up with the institution to see if he was just dismissed from the team or suspended from the institution.

Good Academic Standing Attends a four-year institution for four semesters. Wants to transfer to your Division I institution. You send a tracer form and get her current transcript. The tracer hasn’t come back but the transcript has and it says:

Good Academic Standing What do you do? Nothing, she is not going to be on probation at your institution. Tell the coach she isn’t going to meet the one-time exception and will have to serve a year in residence. Find out what Academic Probation means at the previous institution.

Progress-Toward Degree Implications Four-Year Transfers

Ineligible at Previous Institution One-Time Transfer Exception Year in residence, unless a waiver is granted. Academic based analysis. Progress-toward-degree waiver directive will be applied.

Ineligible at Previous Institution Financial Aid May not receive institutional athletically related financial aid during the first year. Exceptions can be met. Waiver opportunity: Progress-toward-degree waiver directive will be applied. Academic based analysis.

Progress-Toward-Degree Requirements Must be meeting all requirements to be immediately eligible. If not meeting requirements: Progress-toward-degree waiver. Recertification after one term.

CLR 4-4 Undergraduate Waiver Directive

Undergraduate Transfer History January 2014: Transfer Issues Subcommittee recommended that immediate eligibility no longer be provided. Rather, staff would grant a one-year extension of the five-year clock for mitigating circumstances.

Undergraduate Transfer History Recommendation based on membership feedback regarding the number of waivers granted for SAs in high profile sports and perceived inconsistency in decisions. Eighteen (18) of the 31 conferences responding supported the recommendation.

Undergraduate Transfer History April 2014: NCAA Division I Board of Directors approved the recommendation. Effective for those SAs who transfer and enroll during the 2015-16 academic year and thereafter.

CLR 4-4 Undergraduate Waiver Directive Only change: Relief available. Instead of immediate eligibility, SA may receive one- year clock extension. For any undergraduate SA who does not meet a transfer exception.

CLR 4-4 Undergraduate Waiver Directive Institution must still present mitigation for transfer. Examples of mitigation include: Injury/illness. Financial hardship. Run-off. Education-Impacting Disability.

CLR 4-4 Undergraduate Waiver Directive Institution should seek a CLR waiver if: SA has two or fewer denied participation opportunities, and One of the denied participation opportunities is the result of a transfer.

CLR 4-4 Undergraduate Waiver Directive NCAA Student-Athlete Reinstatement (SAR) clock extension waiver still available for two or more denied participation opportunities that do not involve transfer.

Case Study No. 1 2013-14 academic year: SA enrolled at Institution No. 1. SA competed. 2014-15 academic year: SA competed at Institution No. 1. Following the season, Institution No. 1 hired a new coach.

Case Study No. 1 SA was informed by the new coach that she will not have an opportunity to participate on the team moving forward. 2015-16 academic year: SA will enroll at applicant institution.

Case Study No. 2 2011-12 and 2012-13 academic years: SA enrolled at and competed at Institution No. 1. 2013-14 academic year: SA transferred to Institution No. 2. SA sat her transfer year in residence. 2014-15 academic year: SA tore her ACL and did not compete.

Case Study No. 2 At the end of the year, SA informed the coaching staff at Institution No. 2 that she would transfer closer to home to be near her ailing mother and for her own peace of mind. 2015-16 academic year: SA will enroll at applicant institution.

CLR 4-4 Undergraduate Waiver Directive CLR waiver because one of the denied participation opportunities is the result of a transfer. Waiver will be evaluated under the injury or illness guidelines. Therefore, contemporaneous medical documentation will be necessary.
