9 Joint Program Executive Office for Chemical and Biological Defense 041214_SOCOM 9 Associated Press; Oct 1, 2004 ATLANTA – A former Norcross businessman has been charged with misleading investors into believing his company had a product that could destroy anthrax spores. A Federal grand jury indicted 46-year-old Timothy C. Moss, former chairman, president, and chief executive of International BioChemical Industries, Inc., on Wednesday with securities fraud and perjury. The indictment said the company issued misleading news releases claiming it had a product that could kill anthrax spores, after contaminated letters were mailed to government offices and news media in October 2001. Trading volume on the firm’s shares soared, and its stock price tripled as a result. But in March 2002, the U.S. Environmental Protection Agency found that studies of the company’s anthrax disinfectant products failed to prove they worked, the indictment said. Investors duped by the claims lost $1 million to $2.5 million, it added. John Christy, who is representing Moses in a civil case brought by the Securities and Exchange Commission, said Thursday he had not seen the criminal indictment. “I feel confident Mr. Moses will be vindicated of any of these charges,” he said.
