Exemptions for Minors Federal Law Bolded Items contain exemptions for 16 & 17 year –old apprentices –student learners –high school graduates who have completed – training as student learners – when employed under prescribed conditions NY State Law Prohibitions do not apply to minors 16-18 years old who have completed –training as a student learner –trainee in an on-the-job training program –has completed a training program given by a public school.

Prohibited for Minors 1 of 16 Federal Law In or about manufacturing or storing explosives or articles containing explosive components. NY State Law Work in manufacturing, packing, or storage of explosives, or in the use or delivery of explosives.

Prohibited for Minors 2 of 16 Federal Law Motor vehicle driver and outside helper Coal-Mining Occupations in connection with mining, other then coal NY State Law As a helper on a motor vehicle Any occupation in or in connection with a mine or quarry

Prohibited for Minors 3 of 16 Federal Law Logging and/or in the operation of any –sawmill –lathe mill –shingle mill –cooperage-stock mill. NY State Law Logging occupations and occupations in the operation of any – saw mill – lathe mill – shingle mill – cooperage-stock mill.

Prohibited for Minors 4 of 16 Federal Law Involved in the operation of power- driven wood-working machines NY State Law Any occupation involved in the operation of power driven –woodworking –metal-forming –metal-punching –metal-shearing –bakery –paper products machines.

Prohibited for Minors 5 of 16 Federal Law Involving exposure to radioactive substances and to ionizing radiation NY State Law Any occupation involving exposure to radioactive substances and to ionizing radiation, or exposure to silica or other harmful dust.

Prohibited for Minors 6 of 16 Federal Law Involved in the operation of elevators and other power-driven hoisting apparatus. Minors 16&17 years old are permitted to operate and ride on automatic enclosed elevators NY State Law The care or operation of a freight or passenger elevator minors over 16 may operate automatic, push-button control elevators. Any occupation involved in the operation of power driven hoisting apparatus

Prohibited for Minors 7 of 16 Federal Law Involved in the operation of power- driven –metal forming –punching –shearing machines. NY State Law Any occupation involved in the operation of power driven –woodworking –metal-forming –metal-punching –metal-shearing –bakery –paper products machines

Prohibited for Minors 8 of 16 Federal Law In or about –slaughtering, –meat-packing, –rendering Involving the –operation –set up –adjusting –cleaning –oiling, wiping, or repairing of a meat slicer NY State Law Any occupation in or about a –slaughter and meat packing establishment –rendering plant Adjusting –belts to machinery –cleaning, oiling or wiping machinery

Prohibited for Minors 9 of 16 Federal Law Involved in the operation power- driven bakery machines. Involved in the operation of certain power-driven paper products machine NY State Law Any occupation involved in the operation of power driven-woodworking, metal-forming, metal- punching, metal- shearing, bakery and paper products machines.

Prohibited for Minors 10 of 16 Federal Law Involved in the manufacture of brick, tile, and kindred products NY State Law Any occupation involved in the manufacture of brick, tile and kindred products

Prohibited for Minors 11 of 16 Federal Law Involving the operation of power driven circular saws, band saws and guillotine shears NY State Law Any occupation involved in the operation of power driven circular saws, band saws and guillotine shears

Prohibited for Minors 12 of 16 Federal Law Involving wrecking, demolition, and shipbreaking operations Involving roofing operations Involving excavation operations NY State Law Any occupation at construction work including wrecking, demolition, roofing, or excavating operation and the painting of exterior cleaning of a building structure from an elevated surface.

Prohibited for Minors 13 of 16 Federal LawNY State Law Operating or using any emery, Tripoli, rouge, corundum, stone, silicon carbide, or any abrasive, or emery polishing or buffing wheel, where articles of the baser metals or iridium are manufactured.

Prohibited for Minors 14 of 16 Federal LawNY State Law Packing paints, dry colors, or red or white leads. Preparing any composition in which dangerous or poisonous acids are used.

Prohibited for Minors 15 of 16 Federal LawNY State Law Operating steam boilers subject to Section 204 of the Labor Law

Prohibited for Minors 16 of 16 Federal LawNY State Law In penal or correctional institutions –if such employment relates to the custody or care of prisoners or inmates.

Post Test Continued 8.The Phelps cement block company is looking to hire some one on weekends to mix concrete, a minor may apply. 9. Big Bang ammo shop is looking for a custom reloader for competition shooters. You do this at home, as a minor can you be employed to reload ammunition.
