2 OBJECTIVES Bulletin 6541.0 and Major Changes Describe the function and composition of ELAC To acquire the knowledge to run an effective ELAC meeting

Guidelines for the Required English Learner Advisory Committee and School Site Council: Bulletin 6541.0 replaces Bulletin 6332.0

Major Changes: Requires any school with high school students to form a School Site Council with student representation. Requires the posting of a sign advising that recording is in progress at each SSC and ELAC meeting location. Eliminates the 24-hour Emergency Meeting option. Establishes a minimum attendance requirement for continued membership on the English Learner Advisory Committee and School Site Council. Eliminates the five (5) day posting requirement for member and officer elections.

English Learner Advisory Committee (ELAC): In accordance with Education Code 52176(b), all schools with twenty-one or more English learner (EL) students are required to establish an English Learner Advisory Committee (ELAC).

Please Note: When the percentage of EL students in a school constitutes more than 51% of the total number of pupils, parents and legal guardians of EL students shall constitute membership on the ELAC in at least the same percentage as English learner students in the school. Divide the number of EL students enrolled by the total number of students enrolled to get the % of EL students. This is important to ensure that correct % of EL parents or parents of RFEPs (up to two years since reclassification) constitute the ELAC.

ELAC Membership: o Parents and legal guardians of EL students, not employed by the District, must constitute at least 51% of the membership o A parent may continue to participate in the ELAC as part of the English learner parent membership portion of the committee for up to two years after he/her child has been reclassified (RFEP). OTHER MEMBERS: PARENTS: o Parents of non-EL students, not employed by the District o Certificated and classified staff o LAUSD secondary school students. Students under the age of 18 must have parental consent to participate. o Community members – all community members must be verified by the principal o Community-based organizations that support the school o PTA/PTSA/ Booster Club members 51% 49%

ELAC Officers and Duties All ELAC officers must be parents of EL students or of RFEP students who have reclassified within the last two years, who are not employed by LAUSD. Chairperson: Vice-Chairperson: Secretary: Parliamentarian: Presides at all meetings Signs all letters, reports and other communications Serves as the school’s delegate to the ELAC Delegate convening Participates in planning of the agenda. Presides when the Chairperson is absent Represents the Chairperson in assigned duties. Participates in planning of the agenda. Keeps minutes of meetings Transmits true and correct copies to members and other persons Provides all notices in accordance with bylaws Assists in the maintenance of ELAC records Maintains a current roster of ELAC members Participates in planning of the agenda. Assists the chairperson in ensuring all rules and bylaws are followed Assist the chairperson in conducting the meeting in an orderly manner, serving as the procedure advisor to the Chairperson Is knowledgeable about bylaws of the committee, parliamentary procedures, Robert’s Rules of Order and Green Act Participates in planning the agenda

Training ELAC Officers: Schools are responsible for training ELAC Officers Verification of ELAC Officer Training must be certified on the Principal’s Portal by October 31, 2015.

Functions and Responsibilities of the ELAC: Provide written recommendations to the SSC regarding programs and services for EL students. Recommendations should be based on student performance and parental involvement data.

ELAC Mandated Topics: The Importance of Regular School Attendance The Comprehensive School Needs Assessment The Single Plan for Student Achievement (SPSA) The Language Census The English Learner Master Plan “Coming together is a beginning. Keeping together is progress. Working together is success.”

The Recommendation Process: ELAC must provide recommendations to the SSC regarding the five mandated topics. Recommendations made to SSC or principal must be in writing The mandated topic must be listed on the Agenda. The SSC has 30 days to respond to ELAC. (Attch. A) Topic and specific recommendation must be reflected in minutes. Minutes must be accurate and detailed.

3-Step Election Procedures 15 Step 1 Informing: Notify all parents and stakeholders of orientation/ elections. Include date, time, location and the agenda items to be addressed Step 2 Posting: Orientation notices (agendas) and Election notices (agendas) must be posted at least seventy-two (72) hours prior to the scheduled orientation and election. Posting must be outside of the school building and must be continuously accessible for all stakeholders. Step 3 Meeting: Distribute agenda outlining the objective of the meeting (orientation/ election) Explain the roles and responsibilities of committee and duties of officers. Declare all seats vacant. Explain the election procedures for voting. Note: Refer to district policy for complete guidelines

21 Open Meeting Law Any meeting held by the committee shall be open to the public. Any member of the public shall be able to address the committee during the meeting on any item within the subject matter jurisdiction of the council or committee. The committee may not take any action on any item of business unless the item appeared on the posted agenda, or the committee members find, by unanimous vote, that there is a need to take immediate action and that the need for action came to the attention of the committee subsequent to the posting of the agenda.

22 ELAC Bylaws ELAC must use bylaws provided by the District. Bylaws may never conflict with federal, state, or District policies, rules and regulations. Modifications/amendments must be approved by the Local District PACE Administrator.

Robert’s Rules of Order The motion process involves the following six steps: A member makes a motion. Another member seconds the motion. The chairperson states the motion formally placing it before the assembly. The members debate the motion. The chairperson puts the motion to vote. The chairperson announces the results of the vote.

25 Agenda The following details must be included in all agendas: School name and committee name Meeting date, time and location Every item of business to be considered in the order to be presented Opportunity for public input Next meeting date, time and location Remember, if it is not written, it does not exist!

26 Minutes Minutes must include: School name and committee name Meeting date, time and location (specify beginning and ending time) Attendance record Record of quorum being (or not) established Should follow agenda Detailed record of what was discussed and voted on (motions) Must be reviewed for accuracy and approved at following meeting

28 Delegation of Authority In order to delegate authority of the ELAC to SSC, the ELAC MUST first : - Inform all members during a regular (non- election) meeting of the ELAC’s responsibilities - During a subsequent meeting, establish quorum -Discuss and vote to delegate the ELAC’s responsibilities to the SSC -A unanimous vote of the full membership present is required -Record decision in the ELAC minutes - ELAC must be duly constituted Orientation/ Election 1st Regular Meeting 2nd Regular Meeting

29 Delegation of Authority In order to complete the delegation of authority process, SSC members must : - Submit a Delegation of Authority Form signed by the SSC Chairperson and principal to the PACE Administrator for final approval -Participate in training to address all ELAC responsibilities - Accept delegation of authority by unanimous vote

30 Delegation of Authority Does my school qualify to delegate authority? The percentage of English Learners in my school does not exceed 50% (elementary schools) or 25% (secondary school). The SSC has a pre-existing ELAC subcommittee. The % of EL parents participating in the parent portion of the SSC reflects at least the same % as EL students enrolled in the school.
