2 2 A common identification credential for all persons requiring unescorted access to secure area of MTSA- regulated facilities and vessels, and all mariners holding Coast Guard issued credentials.

3 Mandated by the Maritime Transportation Security Act of 2002 (MTSA). Congress directed the federal government to issue a biometric security credential to individuals with unescorted access to secure areas of facilities. Implemented in (2) two phases: 1. Enrollment Phase 2. Biometric Verification/Card Reader Phase. Deadline for Enrollment Compliance: April 15, 2009

4 Enhance Security – Provide a secure, verifiable, common, interoperable credential to manage individual access to secure areas of the transportation system. Facilitate Commerce – Provide a identity management system that maintains, or improves, the access of workers to transportation facilities and the flow of goods. Protect Privacy – Limit the amount of personal data collected and contained on the credential; protect personal data from unauthorized disclosure.

5 Smart Card-Based Supports off-line and on-line biometric authentication — no need to connect to a central database when authenticating. Robust enough to support fingerprint templates and photograph, as well as future biometrics. Supports future technology applications for additional capabilities. Supports multiple levels of authentication Something you have—the credential Something you are—the biometric Something you know—the Personal Identification Number (PIN)

6 Do you require unescorted access to secure areas of MTSA regulated facilities?  Facility and vessel owners/operators are required to notify employees of their responsibility to possess a TWIC based on their need to have unescorted access to secure areas of vessels and facilities. Owners/operators are encouraged to provide this same information to personnel who are not facility or vessel employees (e.g. contractors, truck drivers). Original Estimate-750,000 maritime workers will require a TWIC (Over 1 million enrolled as of April 09)

7 7 TWIC Card is Valid for 5 Years from the Issuance Date

8 Pre-enrollment  Web-based  Recommended, but not mandatory  Will reduce time at enrollment center if completed beforehand Enrollment  At the enrollment center the applicant provides biographic information and identity verification documents  A ten-fingerprint scan and digital photo are taken. All information is encrypted and transmitted to the central TWIC system for processing.

9  Conducted by TSA  Upon successful completion of the STA the TWIC is personalized by the centralized card production facility and shipped to the applicant’s enrollment center  Applicant will be notified when the credential is ready to be picked up OR  Applicant will be notified if he/she may be disqualified and of his/her appeal and waiver rights  Applicant returns to enrollment center to claim credential for use at MTSA regulated vessels, facilities, and OCS facilities

10 10 The assessment includes checks against criminal history records, terrorist watch lists and immigration databases.

12 (1) Espionage or conspiracy to commit espionage (2) Sedition or conspiracy to commit sedition (3) Treason or conspiracy to commit treason (4) Terrorism or conspiracy to commit such crime (5) A crime involving a TSI (transportation security incident) (6) Improper transportation of a hazardous material (7) Unlawful possession, use, sale, distribution, manufacture, purchase…or dealing in an explosive or explosive device (8) Murder (9) Threat or maliciously conveying false information knowing the same to be false, concerning the deliverance, placement, or detonation of an explosive or other lethal device in or against a place of public use, a state or government facility, a public transportations system, or an infrastructure facility (10) Certain RICO (Racketeer influenced and Corrupt Organizations) Act violations (in which the predicate act is one of the permanently disqualifying crimes (11) Conspiracy or attempt to commit the crimes in this paragraph (a)(5)-(a)(10)

14  Appeal: Information used to deny TWIC is incorrect, or enrollment information was submitted incorrectly.  Waiver: Explaining why you are no longer a threat – mitigating Information.

17 17 USCG Responsibilities ◦ Enforce use of TWIC at MTSA regulated vessels. ◦ Develop and distribute field and industry guidance. ◦ Conduct biometric checks as part of facility and vessel compliance inspections.

18  The facility owner operator must ensure that a TWIC program is implemented as follows:  All persons seeking unescorted access to secure areas must present their TWIC for inspection before being allowed unescorted access.

19  This inspection must include:  A match of the photo on the TWIC to the individual presenting the TWIC.  Verification that the TWIC has not expired.  A visual check of the card to determine whether the TWIC has been tampered with or forged.

20  If an individual cannot present a TWIC because it has been lost, damaged or stolen, and he or she has previously been granted unescorted access to the facility and is known to have had a valid TWIC, the individual may be given unescorted access to secure areas for a period of no longer than 7 consecutive calendar days if:  The individual has reported the TWIC as lost, damaged, or stolen to TSA.  The individual can present another acceptable identification credential.  There are no other suspicious circumstances associated with the individual’s claim of loss or theft.

21  If an individual cannot present his or her TWIC for any other reason he or she may not be granted unescorted access to the secure area.  The individual must be under escort, as defined by 33 CFR Part 101 at all times while inside of a secure area.

22  Escorting means ensuring that the escorted individual is continuously accompanied while within a secure area in a manner sufficient to observe whether the escorted individual is engaged in activities other than those for which escorted access is granted.

23  This may be accomplished by having a side by side companion or monitoring.  Monitoring must enable sufficient observation of the individual to determine if they are engaging in unauthorized activities or in an unauthorized area.  Monitoring may be accomplished by:  Use of a closed circuit television system that is monitored by a TWIC holder.  A combination of roving security patrols, automatic intrusion devices or surveillance equipment

24  With the exception of persons granted access for 7 days due to a lost, stolen, or damaged TWIC that has been reported to TSA, all individuals granted unescorted access to secure areas of the facility must be able to produce his or her TWIC upon request.
