34 CFR 300.151-300.153 23 IAC 226.570 An organization or individual may file a signed written complaint alleging that a public agency has violated a requirement of Part B of the Act or the regulations.

Requirements for the Party Filing the Complaint: Submit a signed, written complaint Forward a copy of the complaint to the LEA or public agency serving the child

ISBE requirements: Set aside any part of the complaint that is being addressed in a due process hearing. Complete the investigation in 60 days, unless extended due to: Exceptional circumstances that exist with respect to a particular complaint, or Agreement from the complainant and district to extend the time to engage in mediation or other alternative means of dispute resolution.

The LEA or public agency is afforded the opportunity to resolve the complaint informally – Upon receipt of the letter from the party filing the complaint Upon receipt of ISBEs Opening Letter Anytime throughout the investigative process, (until a Letter of Findings is issued)
