Rapisardi Intellectual Property © - 2010 1.Simple filing procedure The filing procedure is simple; a CTM can be obtained by means of a single application 2.Low registration fee The cost of filing a CTM application is significantly less than multiple filings at the various Member State trade mark offices 3.Independent registration The initial CTM registration period is ten years from the date of filing the application and is independent of any other application or registration 4.No requirement for a national trade mark registration/application Compared to the International Registration system, the CTM system does not require the existence of a registration/application in the applicant’s home country 10 Advantages (I)

Rapisardi Intellectual Property © - 2010 5.Not reserved for EU Member States A CTM applicant is not required to have a commercial establishment in the EU 6.Single opposition proceeding Any opposition will be examined in front of OHIM in a single proceeding rather than putting forward the same arguments in several different EU trade mark jurisdictions 7.Uniform right to protection throughout the EU The CTM registration protects the owner’s rights in the same way in all of the 27 European countries 8.Less vulnerable to cancellation for non-use Use of the mark in a single Member State will suffice to retain protection for the mark throughout the Community 11 Advantages (II)

Rapisardi Intellectual Property © - 2010 9.System of seniority The CTM system of seniority provides that trade mark owners may claim for their CTMs the seniority rights derived from national trade marks in any Country of the EU, thereby allowing those national trade marks to be abandoned without loosing any rights 10.Customs surveillance may be requested in EU countries as well as in most countries of the world. By filing just one application, any EU trade mark or design owner may ask for customs surveillance in all of the 27 EU countries 12 Advantages (III)

Rapisardi Intellectual Property © - 2010 No requirement for a national trade mark registration/application The CTM system does not require the existence of a registration/application in the applicant's home country; the filing requirements for a CTM are therefore also independent of (and may be quite different to) national filing requirements Independent registration The initial CTM registration period is ten years from the date of filing of the application and is independent of any other application or registration. Under the Madrid system on the other hand, any refusal, withdrawal or cancellation of the basic application or basic registration within five years of the registration date of the international registration will lead to the refusal, withdrawal or cancellation of the international registration to the same extent (central attack) 15 Advantages of the CTM with respect to the International Trade Mark (I)

Rapisardi Intellectual Property © - 2010 CTM can be applied for by anyone A CTM applicant is not required to have a commercial establishment in the EU; anyone can file a CTM application. The Madrid System can instead be used only by a person or a legal entity having the necessary ‘connection’ through an establishment, domicile or nationality of any Contracting Party, or of a Member State of an intergovernmental organization (the European Community) A CTM application is granted in less time than an International TM extended to the EU Usually the CTM application is granted in about 12 months (if no official actions or opposition are raised); the Community portion of the International trademark is granted in about 18/24 months. This is very important with regard to requests for customs surveillance, as these can only be filed once the trademark is registered 16 Advantages of the CTM with respect to the International Trade Mark (II)
