MORNING STAR AIRPARK SUBDIVISION Request to Substitute Assurance Agreement Ed Curry purchased the land after a Trustee’s Sale. Mr. Curry’s intent is to preserve the entitlements on the land while continuing to pursue his farming interests on the parcel. Staff is recommending a Waiver of the 3-year limit for making improvements and granting Mr. Curry’s request for 5 years. As a condition of approving the requested waiver, at the end of 5-years, the economic conditions and Mr. Curry’s intent for developing the subdivision be re-evaluated. At that time, if development does not seem likely, Mr. Curry will agree to abandon the plat to prevent a future ‘paper subdivision’.

MORNING STAR AIRPARK SUBDIVISION Request to Substitute Assurance Agreement Staff recommendation: 1.Approve the Substitute Assurance Agreement; 2.Approve the waiver of time limits for development from 3-years to 5-years; and 3.Approve the Condition that at the end of 5- years, Mr. Curry will convey his intentions for development including the possibility of abandoning the plat.
