3. MORNING STAR AIRPARK SUBDIVISION Request to Substitute Assurance Agreement  Ed Curry purchased the land after a Trustee’s Sale.  Mr. Curry’s intent is to preserve the entitlements on the land while continuing to pursue his farming interests on the parcel.  Staff is recommending a Waiver of the 3-year limit for making improvements and granting Mr. Curry’s request for 5 years.  As a condition of approving the requested waiver, at the end of 5-years, the economic conditions and Mr. Curry’s intent for developing the subdivision be re-evaluated.  At that time, if development does not seem likely, Mr. Curry will agree to abandon the plat to prevent a future ‘paper subdivision’.
