8 ICESCR Article 12.1 1. The States Parties to the present Covenant recognize the right of everyone to the enjoyment of the highest attainable standard of physical and mental health.

9 What is the right to health? Available, accessible, acceptable health facilities, goods, & services that are appropriate & of good quality Freedom to make decisions about one’s own health Entitlement to a system of health protection Concerns factors leading to a healthy life – ‘underlying determinants of health’

10 What is the right to health? Non-discrimination Participation Government obligation to respect, protect, & fulfil the right to health Monitoring Accountability mechanisms Remedies

12 What the right to health is NOT? The right to be healthy ONLY a long-term programmatic goal Economic difficulty does not absolve a state’s obligations Will be resolved overnight

13 What about women? Using a gender perspective means recognising that both biological & socio-cultural factors play a role in influencing the health of women… Policies & programmes must consciously set out to address these differences.
